Immigration fight heads to federal appeals court [hearing today]

In a key test of President Barack Obama's efforts to overhaul immigration law without congressional action, administration lawyers will on Friday ask a federal appeals court to lift an injunction blocking his executive action meant to help undocumented immigrants.

Issued in February by Texas-based U.S. District Court Judge Andrew Hanen, the injunction halted programs unveiled in November intended to shield 4.7 million undocumented immigrants from deportation.

The programs angered many Republicans who accused the president of executive overreach and granting amnesty to lawbreakers, but drew praise from immigrant rights advocates.

Hundreds of pro-immigrant advocates are expected to rally in front of the U.S. Fifth Circuit Court of Appeals courthouse in New Orleans where arguments in the case are set to be heard.

On April 7, the Fifth Circuit ruled that U.S. Immigration and Customs Enforcement officers and the state of Mississippi lacked standing to sue over a separate immigration action issued by Obama in 2012 allowing immigrants brought to the United States as children to stay.

That decision may signal that the three-judge panel hearing arguments on Friday could be inclined to temporarily lift Hanen's injunction, some observers said, which would let the administration proceed with implementing the president's landmark immigration action.

I hate this kind of rhetoric!! No one who wants immigration laws enforced is anti immigrant!! We are anti-illegal immigrant!! Enforce the laws!! Is a cop who pulls a speeder over “anti-driving?” We’re doomed.

Illegal aliens are NOT immigrants. Immigrants apply to be Americans, wait their turn and comply with our laws.

Illegal aliens do not.

Illegal aliens should always be referred to as illegal aliens. It is an insult to actual immigrants to conflate the two and the left is using that conflation to advance the invasion of our country by illegal aliens.

What is happening IS NOT immigration. It could beter be described as colonization.

Wonder how much ‘unofficial’ pressure from ‘officials’ has been applied to the Judge since his last decision.

The ‘officials’ in the Administration do not like being denied.

[If this Judge doesn’t fold, he might be a good candidate to replace SC CJ Roberts.]

That court is one of the most conservative in the nation, and the random selection for judges to serve on the panel resulted in two conservatives and one liberal being chosen.

At issue are Obama’s executive actions taken last fall that would grant amnesty to as many as 5 million illegal immigrants currently living in the U.S. In February, a federal judge in Texas issued a ruling that temporarily blocked the administration’s measure.

The administration wants the immigration orders put into action, and now it’s looking for the Texas judge’s ruling to be lifted by the Fifth Circuit U.S. Court of Appeals.

The panel features conservative judges appointed by President Ronald Reagan and President George W. Bush. The other judge is an Obama appointee.

The conservatives on the panel, Judges Jerry Smith and Jennifer Walker Elrod, have ruled against the Obama administration in the past in cases concerning the Affordable Care Act and immigration.
