New Republic Writer: Hillary ‘Simply Has to Select Barack Obama As Her Running Mate’

The title of a famous essay by Jonathan Swift and that of a Tuesday New Republic article by Brian Beutler each starts with “A Modest Proposal.” There are, however, many differences concerning the two pieces. One is that Swift’s was a satire, whereas Beutler’s is a fantasy. Another is that pretty much anyone who somehow took Swift’s proposal seriously would find it horrifying, while Beutler’s suggestion -- that the 2016 Democratic ticket should consist of Hillary Clinton and Barack Obama -- will horrify mostly conservatives (and opponents of dynastic politics who already were upset over the prospect of a Hillary v. Jeb race).

There is a plus to this Modest Proposal. Such an act WOULD justify overthrowing the dictatorship and gassing every member of the government for blatant treason against the Constitution they swore to preserve, protect and defend...

It's not so cut and dried. There is room for mischief. From Wikipedia:

Under the Twenty-second Amendment, the President of the United States may not be elected to more than two terms. However, there is no similar such limitation as to how many times one can be elected Vice President. Scholars disagree whether a former President barred from election to the Presidency is also ineligible to be elected Vice President, as suggested by the Twelfth Amendment. The issue has never been tested in practice.

To be clear, here’s the last sentence of the 12th Amendment:

“But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.”

That seems more clear than “suggested”.

Stupid fantasy. No person ineligible to be president may be vice president.

Nor could anyone who isn't a natural born citizen be president.

No person ineligible to be president may be vice president.

Unfortunately, the 22nd Amendment does not say that. Being elected to the office of vice-president is not being elected to the office of president.

No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once.

Still not quite so clear.

Someone elected as President is still eligible to be president because he is natural born and 35 or more years of age.

He just cannot be "elected" to the office of President.

For instance, if a two term President were to somehow become speaker of the house and the succession came down to him, he could assume the office.

At least that could be argued.

Yep. Here's the bottom line, IMHO. When it comes to presidential elections, if the majority of voters want something to happen, it will happen. Any vagueness in the Constitution will be twisted to conform to the wishes of that majority.

An obvious example of that is Obama's eligibility as a "natural-born citizen". The majority wanted him, so we got him, eligible or not.
