If there is a forced rape in progress, and the person intervening is 80, I’d say a shot to the head at close range. You can’t risk trying to scare off a young violent felon so nuts he is raping a woman in front of witnesses. That is mad-dog crazy. At 80, I would not feel obliged to reason with a mad dog committing a rape. Shot to the head. Stop the forcible rape in progress, the best and fastest way possible. Bang.

Not if you are stopping a violent forcible rape. I don’t care what grand jury you go in front of, you will not be charged. I would treat a rape in progress the same as a murder in progress or a stabbing in progress etc. Full deadly force, no warning, no nothing. Baseball bat to head, shot to head, whatever it takes to make the mad dog stop like right this second, not the next minute. And at age 80, even less reason to hesitate, since the tables could be easily turned by a young violent felon committing a heinous crime that could get him locked up for 25 to life.

Never, ever fire a warning shot. If you shot the assailant(s), when the cops arrive say you would like to speak with an attorney and say nothing else.

That's a good policy when one is experiencing a personal attack, but in the given scenario, when one is witnessing a girl getting gang-raped, a warning shot to scatter them would be prudent. I'm not a lawyer, but I would think that if you were then attacked, you could fire at will and argue later that you tried to save the girl without shooting anyone. The reason that the warning shot would be necessary is because there are multiple people involved and simply claiming you have a gun, even brandishing the gun, might not be enough. Crowds are weird that way. However, a gunshot gets people's attention, and panic fleeing might be the natural result.

Your post seemed to miss the entire point of the thread. So what if 80 is a bit old for defending against rapists? And If he’s got his pistol in hand—no, 80 is not too old. So the comment is a bit suspect, if not just plain empty headed.

I can’t imagine why anyone would waste their time commenting on the guy’s age instead of paying attention to the problem being discussed.

A bullet to the head is just what I would have expected my daddy to do.

Me, I probably would try to get their attention and hopefully stop everything.

I guess a shot tot he head would also get everyone’s attention too.

You just never know what a jury and judge will do tho. My Grandpa Bill as I called him, killed a really bad man in a gunfight. The guy first came out on the porch, fired one shot in the air then 5 more at Grandpa Bill. Grandpa Bill had been hiding behind the gate.

After the 6th shot he stepped out in the open and killed him with a Winchester model 92.

It was clearly self defense but in that era. Florida did not have a stand your ground law. You were expected to flee. The jury found him guilty of manslaughter with a recommendation of mercy. The judge gave him 20 years in Raiford.

Fortunately the Governor knew an injustice had been made and gave Grandpa a full pardon after he served a year.

That was not the question posited. If I saw a violent rape in progress intervention is a must. As fo an 80 year old man, unless he is exceptional, let him call the cops. The answer is simple to the posited question the people don’t act because they fear retaliation from the government or the perps.

Don't be so naive. There might be 6’2” 215# 80 year olds around who still work as carpenters and strap on a 1911 that they use at the range regularly, but there aren't many. And of the ones there are, they aren't going to be mystified about how to handle a gang rape - they're either going to leave and call the cops or suck it up and make some serious, loud demands to cease and desist - followed up by bullets.

There's a certain amount of serious lack of bullsh*t that would go with such an 80 year old man, and it isn't expressed by the timidity and ignorance of this OP. There's an old saying about such old people - don't try to fight them, they'll just kill you.

So don't be a jerk yourself. I don't like being lied to, and I say something when I think I'm being jerked around.

You do not know the whole story and it is not worth putting your life on the line.

It’s good to imagine “what if” scenarios just like this one and come up with all the possible variables and responses. It really helps you to be prepared and trains your mind. There’s a few good possibilities mentioned here in this thread. Also, keep in mind that things like this never “go as planned.”

Just saying to take everything into consideration; state laws and the situation.

If you are in a bad situation with limited ammo you might use those warning shots more judiciously.

Many a DA will say "If you were truly in fear why didn't you shoot the perp?"

Obviously every situation is different and it is better to think about these things now than at the time.

Be a good witness. Call 911, and describe in detail the perpetrators. Draw and shoot if they come at you.

The problem for you is, you don’t really know it’s rape. There are some sick people in the world, it could be some pervs living out their fantasy. At least that’s the advice my CCW teacher gave us.

I don’t know why someone would be low on ammo, or why they would be using bullets that they feel is putting them in a position of being without a gun, but as far as being careful using warning shots, that is good advice, I aaume that in every case that comes to the attention of authorities you will have to justify your shots and where they went and so on, and that could vary from being terrifying in Los Angeles, to being pretty simple in Houston.

In Houston I did know of a guy in the early 1970s who the cops told him that he could be in trouble having fired his warning shots into the air, and that he should have fired them into the grass.

My dad was lazy, and when he would hear a noise at his place, he would walk out into the dark and fire 3 or 4 shots into the air, and just go back to bed.

For me personally, I don’t like many binding rules, and using general advice for the public, doesn’t suit me very well, if my ability to control a situation needs me to show intent, then I will, if the situation is to kill a man unnecessarily or take the risk of being hassled for a warning shot or two, I will accept the legal hassle.

That is the tough part, before we can be bold and take deadly actions in public, among all the diversity of appearances and activities, and wild and crazy stuff that is life in the big city, we have to be sure that we know what is going on.

We don’t even really know all the facts about this case yet.
