Senators seek probe of claims US workers fired, forced to train foreign replacements

A popular visa program allegedly is being misused by U.S. companies to lay off thousands of American workers and replace them with foreign labor.

And, adding insult to injury, many of the laid-off workers allegedly have been forced to train their replacements, in what one anonymous whistleblower called a “humiliating” experience.

The allegations have caught the attention of a bipartisan group of senators -- including immigration hawk Sen. Jeff Sessions, R-Ala., and the No. 2 Senate Democrat, Illinois’ Dick Durbin -- who are calling for a federal probe. A letter sent by 10 senators urging an investigation specifically cited reports of the firing and hiring practices at Southern California Edison, California's second-largest utility. The incidents are concentrated in the IT field, and involve American workers being replaced by H-1B visa holders.

“A number of U.S. employers, including some large, well-known, publicly-traded corporations, have reportedly laid off thousands of American workers and replaced them with H-1B visa holders,” the senators wrote. …

These are supposedly smart guys, right? Did it occur to any of them to do a bad job teaching the replacements? D'oh!

“This would constitute fraud.

In order to request an H-1B visa for a foreign worker, an employer needs to certify that there is a lack of qualified American workers available to do the job function , hence the need to look towards foreign labor.

To hire foreign workers on a H-1B visa in order to fire existing existing American workers is not the intent of the program.”

The Department of Homeland Security was supposed to defend the borders but now they are using our tax money to fly in the invaders.

I call bullshit. You are probably one of the pukes benefiting from this scam. They work for less because the money goes very far back home and so they will work for far less. Also because the H1B is the path to a green card and permanent residency they are modern indentured servants. It takes years to get a green card and if they quit working for their original sponsor the multi-year process starts all over.

Just what the hell do you do and employ to have this opinion?

They work for less because the often have 4 of them living in a 2-bedroom apartment within walking distance to work or a bus stop. Maybe one in four is allowed to have a drivers license and car for the rest.

They should also look into the L-1 visa practices.

I think they are also paid sub par wages by funneling them(wages) thru an employment agency back in their home country. The individuals are never an employee of the American corporation. The slime balls are very creative in the methods of violating the spirit of the law and azzholes like “Zukerburgs” and “Gates” are reaping tons of money.

This was also a big issue in the financial sector. I’m shocked at how many American guys I worked with at big banks/financial institutions have been replaced by trafficked women (mainly from Asia).

In the financial sector, severance packages hinged on training the replacements.

This whole issue is causing young Americans to devote so much to keeping their options open that they will never raise children (and therefore buy a home); the ripple effect of this has “fundamentally transformed” our country.

Well put; they are modern indentured servants (and not paid as little as many believe). The open border to the south provides a steady stream of blue-collar “replacement Americans”; Asia is providing a steady stream of the same for white-collar jobs.

I couldn’t imagine the rage of young Americans today; I’m familiar with that of older Americans because I see it, but I don’t know many twenty-somethings (and they have lost their futures to this scheme).

I live in a small, very traditional old New England town. Two of the banks in town seem to employ no one but women from India. I have no idea where they find these women -- I'm pretty sure they don't live in town. It's truly bizarre and just screams out that the banks have very specific hiring practices which would exclude any American from even attempting to find employment there.

Forced as in fired without severance package if they did not train their replacement.

From what I understand, refusing to train your replacement is grounds for being fired. I think states' unemployment insurance kicks in only if you are laid off, not fired, so there's the other nail in the stick to what the American with.

Like the other commentators on this story however, I remain skeptical that this investigation will go anywhere. Crony industries pay Senators specifically to look the other way on most matters. These used to be called bribes, but this Republic is fat too gone for such quaint notions as equal enforcement of law.

I deal with more of the HQ and back-office people at banks, but have noticed the same in local bank branches. Not even just Indians; they also hire a lot of Hispanics, and a lot of the managers seem to be Eastern European women. All of the middle-aged American women (with considerable experience/knowledge) that used to work there are gone...

exactly this has been happening for a long time. Either train local H1B or off-shore replacements.

As I have explained here before, I have personally seen a company (a Federal contractor, no less!) write job requirements that were impossible to meet -- requiring 5 years experience with something that had been on the market for 3 -- in order to "justify" hiring an H-1B. (No H-1B candidate could meet the requirement, either, but nobody checks for that.)

It happens all the time.
