Brilliant move by this judge. On top of everything else (I recommend a full read of the linked article), he puts the DOJ into the position of having to argue that the words of the President don't apply - and he's the one who set the policy and is demanding its implementation.

By waiting to see the outcome of the Mississippi case (5th DCA) Judge Hanen has essentially removed one weapons which the DOJ attorneys could use against his own ruling when it enters the same appellate court.
