Not entirely, it depends on the judge who tries the case.
If a judge misinterprets the intent of the law, nothing can stop him from seeing what he wants to see.
Look, we have a great constitution, one of the best in the world. Did that stop Justice Roberts from deciding that government can force us to buy healthcare?
