Justices reject appeal by US flag-wearing students (Morgan Hill CA)

The Supreme Court has denied an appeal from former California high school students who were ordered to turn their American flag T-shirts inside out during a celebration of the Cinco de Mayo holiday at school.

The justices did not comment Monday in leaving in place an appellate ruling that found that school officials acted appropriately because their concerns about racial violence outweighed students’ freedom of expression rights. Administrators feared the American-flag shirts would enflame (sic) the passions of Latino students celebrating the Mexican holiday. …

Nope. They just didn't take this particular case, which left the appellate court decision (which is applicable only within the Ninth Circuit) in place. SCOTUS only grants a very, very small percentage (1-2%) of the cert petitions it receives.

In the late 60’s they made the precise opposite ruling in a case that involved high-school students who protested Vietnam by wearing black armbands at school.

So....does the speech have to be anti-American to be permissible? Or do threats of violence trump the First Amendment?

I don’t even fault the SCOTUS for upholding the school. The fault is not the SCOTUS for recognizing that school children on campus basically have no 1st amendment rights. The fault is with today’s PC climate as well as the commies running the schools. In my day, the hispanics would have been told to like it or lump it or take a hike.

It is the PC idiocy of modern life and the communist hijacking if the schools that is the problem, not the SCOTUS recognition that they don’t have the power to interfere in the schools where students do not have 1st amendment rights, per se.

I know my opinion will be very unpopular. Please don’t bother to respond.

Maybe the students could wear a French flag. They could remind any offended students that Mexico being conquered and under French rule in the 1860’s was simply a part of Mexican history and that they should celebrate their history! Vive la republique!

It was never very likely that the Court would take this case. This case reached the Court as a case that weighed freedom of expression against concerns about violence. There is a long line of cases that grant schools pretty broad powers to restrict student speech if they do so in the name of preventing violence. The current Court has never shown an interest in overturning that line of cases, so the most likely result in this case was that the Court would just let the appellate decision stand without taking on this case.

When American diplomats live in Mexico, they don’t send their children to Mexican schools. Same goes here. If a school names itself Mexican in America - get out and starve it to death.

But let one or more wetbacks come to school (there's something wrong with that combination of words) wearing Aztlán tee shirts, and the administration would celebrate.

Not enough actual American kids willing to go beat the crap out of them to send the message: "Go Home To Mexico", I guess...

I think this argument was because it was a Hispanic day - Cinco de Mayo, and wearing the American flag was supposed to be “insensitive” to the Hispanics.

WHAT WERE YOU EXPECTING .. MORGAN HILL IS RIGHT IN THE MIDDLE OF AN ALMOST TOTAL HISPANIC POPULATION.

From now on I plan to wear my American Flag Tee-Shirt on Cinco de Mayo.

Why should EXEMPT SCOTUS care about the miserable
Americans and their children below them, who are not EXEMPT?

After all, EXEMPT SCOTUS and EXEMPT COngress
have made America a three-tier law system.

1. EXEMPT - no laws apply to these criminals
2. Criminal illegals - above all Americans
3. Americans (scum to Congress, SCOTUS and the criminals)
- useless to the EXEMPT, except for their organs.

Sounds like if the American kids threatened violence against anyone flying the Mexican flag, then the Mexican flag should be prohibited. Fat chance; any students protesting the Mexican flag would probably be thrown out of school and prosecuted.
