Gowdy: 'Our Committee Doesn't Have the Power' to Seize Hillary's Email Server

(CNSNews.com) - The House Select Committee on Benghazi will not subpoena Hillary Clinton's email server, because it can't, committee chairman Rep. Trey Gowdy (R-S.C.) told MSNBC's "Morning Joe" on Wednesday.

"Well our committee doesn't have the power -- under our rules, we don't have the power to seize a personal property like that. The House as a whole, that's franky an open constitutional question as to whether the House as a whole has that legal authority, but frankly, we shouldn't have to compel it," Gowdy said.

"You can subpoena but the power to subpoena is only as good as the power to compel compliance," Gowdy, an attorney, said. "But rather than have that protracted legal battle, I don't know why she doesn't just turn the server over."

At her news conference on Tuesday, Clinton said the private email server she used during her time at the State Department "contains personal communications from my husband and me, and I believe I have met all of my responsibilities and the server will remain private."

SoS email falls within the scope of the Benghazi investigation.

That is only a murder investigation. We need something more serious, like a Watergate burglary.

I would argue it is better to attack a more lightly defended position than one defended by mines, barb wire and many machine guns.

Only a handful of incriminating e mails are required. There are lots of places they may be obtained. the government of Say United Kingdom or Saudi Arabia or Israel. Then there is the entire US government

Yes, but the DOJ has the right to seize the Server, and they have the power and the right to investigate this to the fullness of the law

Since laws are only for Republicans and the citizen rabble it will never happen....but if Hillary had been a Republican that server would have been confiscated by the government by now.

People are going to get tired of being forced to follow laws dems do not have to and when that happens it will not be pretty.

We will not get the server until after we get the Presidency in 2016. Then the new head of the Justice Department must order seizure of the server and if classified material was not submitted to the archives, arrest Hillary and jail.

I’d be very surprise if a congressional investigatory committee lacks authority to compel the production of evidence. But it’s too late now. Hilary’s undoubtably destroyed it completely by now. It’s probably all melted down and on a rocket to Uranus by now. This investigatory committee needs a new chairman
