But negotiating with Ortega, well, that came under the “Pan-American” umbrella, doncha know, not the same thing at all, and besides it was just a political tug-of-war with Reagan and the White House at the time.
And that was by no means the only instance Jean-Francois Kerre` decided to do a little “free-lancing” in foreign policy.
I think there was a law on the books, probably still is, but it has largely become dead letter. The Logan Act has pretty much been shredded over the past couple of decades.

They dont have the right to modify an agreement reached, executive to executive, between the leaders of two countries.
Why????? Why, when politicians parse words are they never called on it? The Senators plainly stated, PLAINLY, that when Obama was out of office the next President could modify or declare the executive action null.
There is no doubt that a President, or anyone else, cannot ratify a Treaty without a 2/3 majority in Congress. It shouldn’t even have to be brought up. Especially with a “Constitutional Scholar” in the White House.
