Supreme Court Justice Antonin Scalia seems to have faith that Congress would fix Obamacare if the Court weakens it—but not so much faith in the Congress that wrote the law in the first place.
Solicitor General Donald Verrilli, arguing on behalf of the Obama administration, warned the Court during oral arguments in King v. Burwell on Wednesday that a ruling invalidating Obamacare's insurance subsidies in most of the country would have disastrous consequences. Premiums would skyrocket, millions of people would lose their coverage, and many states' individual insurance markets could descend into chaos, he said.
But Scalia wasn't sure it would be that bad.
"What about Congress? You really think Congress is just going to sit there while all of these disastrous consequences ensue?" he asked Verrilli. "I mean, how often have we come out with a decision … [and] Congress adjusts—enacts a statute that takes care of the problem? It happens all the time. Why is that not going to happen here?"
"This Congress, your honor?" Verrilli replied. "Of course, theoretically, they could."

I interpret this to mean Scalia will side with plaintiffs because Congress has the power to fix it.
But of course the current Congress and like subsequent Congresses will table any bill that sustains ACA in its current form.

Well, that would fix it in my opinion.

I think Scalia would rule on the constitutionality of the law regardless of the outcome or what Congress would or would not do about it. As he should.

And the Democrats will filibuster any Republican attempt to replace it or repeal whatever is left.
That is the Congress that the people elected isn't it? Or is it that they expect the Congress to be in charge when Democrat's control Congress, and the courts to be in charge when Republicans do?
Of course they will. They’re not suicidal. They’ll pass a 60-day extension, and Obama will have to sign. That will give them time to come up with a bill that will radically change the ACA, and pass that.
Then Obama will have a choice of yielding to what the Republicans want, or leaving millions of people without health insurance. Either way, they’ve got him right where they want him.
Justice Scalia has a wonderful sense of humor.
Harry Reid and his troops will filibuster any revisions to Obamacare the Republicans write. Obama will have the Repubs where he wants them. Any sob stories will be blames on the repubs. And then the repubs will fold and acquiesce to Reid.
This has been the goal all along. I keep saying it. Don't think anyone believes it, but if SCOTUS invalidates the law, single payer will then be initiated. Watch. That's been the goal. That is what they will get, and the spineless, worthless GOP won't do a damned thing to stop it.

I have to repeat what I wrote on another thread:
Justice is supposed to be blind.
Determining the outcome of any case based on what its results will be is......actually.......ILLEGAL!
Yet, that’s what SCOTUS wants to do here.....as Kennedy asked what the results would be of a ruling for the plaintiff’s......he’s blatantly wrong to even ask the question or consider it as a factor!
The ruling is simply supposed to determine WHAT THE LAW SAYS - no more, no less!
That these considerations are even being discussed clearly says we are no longer a nation of laws........but it’s really been that way a long time.......how about Roe v. Wade?????????

I was most disgusted by the obvious attacks on the plaintiffs by Kagan and Ginzburg. Kagan’s example was just dumb.
Roberts has been said to not want his court to be politicized, The leftists there abandoned legal arguments and instead worried about the results, pushing an agenda instead.
I am no laywer but they didn’t worry about the results in their other decisions such as homosexual marriage, pushing an agenda instead..
