Simple. The Baker owned the bakery. This guy is an employee of COSTCO. I would imagine if the owner of a bakery was OK with the gay wedding cake, but an employee said they would not do it, the employee would be looking for a new job.

The proper analogy is if I walked into a mid-eastern restaurant operated by a muslim and ordered a ham sandwich. When the owner says he doesn't have ham sandwiches-—I sue him for discrimination.
