The powers behind the FCC’s muscling of the Internet
NRO ^ | John Fund

oday’s vote by a bitterly divided Federal Communications Commission that the Internet should be regulated as a public utility is the culmination of a decade-long battle by the Left. Using money from George Soros and liberal foundations that totaled at least $196 million, radical activists finally succeeded in ramming through “net neutrality,” or the idea that all data should be transmitted equally over the Internet. The final push involved unprecedented political pressure exerted by the Obama White House on FCC chairman Tom Wheeler, head of an ostensibly independent regulatory body.

“Net neutrality’s goal is to empower the federal government to ration and apportion Internet bandwidth as it sees fit, and to thereby control the Internet’s content,” says Phil Kerpen, an anti-net-neutrality activist from the group American Commitment.

The courts have previously ruled the FCC’s efforts to impose “net neutrality” out of bounds, so the battle isn’t over. But for now, the FCC has granted itself enormous power to micromanage the largely unrestrained Internet.

Three unelected people DO NOT HAVE THE LEGAL AUTHORITY OR JURISDICTION to make law.

They will file lawsuits but ultimately submit for further punishment and abuse.

More importantly, the government will abuse its powers here to coerce those operating and operating on the Internet to consent to things that have nothing to do with the Internet...just as the SEC/FCC forced the various telecoms to sign agreements to turn over call metadata to the NSA every month in return for being able to perform various basic business functions.

The FCC is lawless.

Remember they promised to release the papers after the vote, and they still refuse.

Nevertheless, 3 unelected people do not have the jurisdiction or legal authority to make law.

Remember too the FCC chairman refused to go before congress.

Their lawless and the Republican congress is doing nothing to stop this and reverse it.

Why is this a bad thing?

Because 1) it’s not an actual problem, and 2) because the Internet relies on prioritization to deliver real-time services. As an example, alarm traffic is set for a lower priority (and capped bandwidth) than real time video traffic. If not, then a router bouncing could quickly squelch out your TV feed. Likewise, e-mail traffic is set lower than your voice calls. Would you really be happy with bits and pieces of your phone call being delayed for a day or two (or even several seconds)?

Everyone needs to keep repeating this over and over.

So any type of enforcement of this is illegal.

Technically they are not. They are radically reinterpreting a law from 1934.

They are making law bypassing the U.S. Congress.

They cannot do that.

They are trying to tax and hold people to legal standards passed by congress.

It’s flat illegal and they are breaking the law by lying and trying to trick the public.

I’m sorry but three unelected people DO NOT HAVE THE LEGAL AUTHORITY OR JURISDICTION to make law.

They are acting outside the U.S. Constitution.

They can do anything they want as long as no one is willing to stop them.

Well then they are completely lawless, and its only a matter of time until it descends down to the public.

On a postive note, will be doing away with the tolls on the NJ Turnpike!
