On Monday, the Justice Department asked a federal judge in Texas who issued an injunction last week against President Barack Obamas executive amnesty to stay his injunction. The Obama administration also proposed that the judge issue a partial stay that would allow every state except for Texas to start implementing Obamas executive amnesty.
The Justice Department gave U.S. District Judge Andrew Hanen until Wednesday to decide on the matter. If Hanen does not act, the Justice Department will ask the 5th Circuit Court of Appeals for a stay.
The Justice Department argued that the Department of Homeland Security would sustain irreparable harm that would not be cured even if the Obama administration wins its appeal. The Obama administration alleged that a stay pending appeal is necessary to ensure that the Department of Homeland Security (DHS or Department) is able to most effectively protect national security, public safety, and the integrity of the border.
Allowing the preliminary injunction to remain in place pending appeal would also harm the interests of the public and of third parties, who will be deprived of the significant law enforcement and humanitarian benefits of prompt implementation of the Guidance, the Justice Department argued in its filing.

The attorney who wrote that should be disbarred. You can't lie to the court in a brief. That is such a bald faced lie that it does not even deserve a response, other than referring the attorney to the state bar for purposes of discipline.
The total is 26 states including Texas. There are several states sitting on the fence ready to join.
Obama’s stay request is a joke. I would hazard a guess that it is to appease the illegal alien advocates such as Luis Guiterrez (D-IL).

I can't imagine how the administration can claim with a hint of honesty that the inability to issue work permits to illegals is inhibiting DHS, or putting the nation at risk.
They can't just say this stuff in a brief, they have to show some evidence, don't they?
How can there be a question about enforcing current law? The whole issue is that bam bam is ignoring the law in the first place.

And it’s the federal department of Justice that is making this proposal! The federal district court judges in the states are falling over like dominoes on homosexual marriage because federal law is supposed to be consistent.

They know they can show outrage and pretend they give a cr@p what the judge said. They have stopped nothing, nor will they, because like the illegal they protect, there is no penalty for their action.
