It is remarkable that despite all of the political talent, goodwill and positive momentum Barack Obama had when he came into office, his policies – both domestic and international – are in tatters. And it is ironic that the former law professor’s two biggest “accomplishments” — Obamacare and executive orders on immigration — are hanging precariously by a legal thread.
The long arm of the law is catching up with Obama. The King v. Burwell ruling looming in the Supreme Court could completely undermine the viability of Obamacare if the justices rule that the law be interpreted as written, not as the White House now hopes. Meanwhile, 26 states have brought a case that would prevent Obama’s executive orders on immigration — which would create new exceptions for many individuals to stay in the United States in defiance of what has, up until now, been a well-established law — from being implemented. A federal court judge has issued a temporary injunctive order declaring that the case against the president can go forward. In both cases, Obama is left hoping that a sympathetic court will allow unprecedented one-man rule and create a new era in which a president can rewrite existing laws in a manner never contemplated in the Constitution.
The president’s glaring disregard of the plain language of the law is finally getting its day in court. His inability to orchestrate legislative victories and make our system work means he has turned to what suits his talent and personality best and what he probably wanted to do all along: govern by fiat. Much of Obama’s legacy is now dependent on the notion that he can declare what is plainly written in the law doesn’t apply or actually means something besides what the words on the page suggest.

I’m so sick of people referring to him as a law professor. He never was a professor. He was an adjunct lecturer. What he lectured on, part-time, was Rules for Radicals by Alinsky. He was regarded by the real professors as lazy.

REFERENCE ACA SEC. 4002. PREVENTION AND PUBLIC HEALTH FUND.
(a) PURPOSE. It is the purpose of this section of the ACA to establish a Prevention and Public Health Fund (referred to in this section as the ‘‘Fund’’), to be administered through the Department of Health and Human Services, Office of the Secretary, to provide for expanded and sustained national investment in prevention and public health programs to improve health and help restrain the rate of growth in private and public sector health care costs.
(b) FUNDING.—There are hereby authorized to be appropriated, and appropriated, to the Fund, out of any monies in the Treasury not otherwise appropriated—
(1) for fiscal year 2010, $500,000,000;
(2) for fiscal year 2011, $750,000,000;
(3) for fiscal year 2012, $1,000,000,000;
(4) for fiscal year 2013, $1,250,000,000;
(5) for fiscal year 2014, $1,500,000,000; and
(6) for fiscal year 2015, and each fiscal year thereafter, $2,000,000,000.
(c) USE OF FUND.—The Secretary shall transfer amounts in the Fund to accounts within the Department of Health and Human Services to increase funding, over the fiscal year 2008 level, for programs authorized by the Public Health Service Act, for prevention, wellness, and public health activities including prevention research and health screenings, such as the Community Transformation grant program, the Education and Outreach Campaign for Preventive Benefits, and immunization programs.
(d) TRANSFER AUTHORITY.—The Committee on Appropriations of the Senate and the Committee on Appropriations of the House of may provide for the transfer of funds in the Fund to eligible activities under this section, subject to subsection (c).

Regrettably, I cannot mount a strong argument against your prediction.
I know they are going after the subsidy part of Obamacare in Federal courts (A case which appears to be strong, I might add, but Obamacare itself was passed on a legislative process known as reconciliation...a maneuver typically reserved for budget items. Furthermore, by using this trick, the Bill was technically created in the Senate. According to our constitution, all spending bills must begin in the House of Reps. The bottom line is, even the stuff that appears ‘solidly’ and legally in place regarding Obamacare is also probably unconstitutional. It would be nice if we had an actual opposition party and a tenacious media to point this out, but no.
In regards to executive amnesty, that one is not even close. Clearly, the President has no power to re-write laws. He can choose not to enforce them using so called executive discretion (which is sad enough), but he can’t then choose to change the laws.
If Obama wins both the Obamacare court case and the amnesty case, what then is the point of even having a congress? The decision would pretty much mean the President can do whatever he wants. I know the libs would party on if those cases fall their way, but soon enough a GOP President will be on the scene using his pen to lower capital gains taxes, reduce Welfare payments, raise the Social Security Age limit, change the Immigration Laws to something they don’t like etc etc and then they will finally realize the damage they have done to this country.
By the way, this is not to be a defense of our congress. Immigration reform is needed and Healthcare, Social Security, Medicare etc needs reforming. These are clearly difficult matters that are frustrating when we see no action taken. With that said, when political consensus can not be achieved, the status quo prevails....the idea being that eventually one argument will win out as political pressures build.
That’s our system...unless the Supreme Court Destroys it with irrational Obamacare and Immigration rulings. Unfortunately, I expect our system to be destroyed.

All he needs is one good crisis at the right time to fulfill his ambitions to consolidate all power in the executive branch. And he’s not that far away from doing it. He’s already steamrolled the congress. That was pretty easy for him to do but now he has to eliminate any opposition from the courts.
If the courts don’t shut down his unilateral and illegal immigration decree, we are dangerously close to being a dictatorship. He will determine what the law is and isn’t.

yes, you are correct in your assessment.
If obamacare is struck down by USSC (Roberts? bought or just rented?) that does not mean it will go away. Obama is rapidly elevating himself above the Court and Congress. The recent ruling against amnesty in the district court is being ignored except for changing what certain actions are called and legalization and voting rights will proceed rapidly. By the end of this year I expect Obama to feel he is in a position to openly defy the Court and Congress. Actually the Court may not be a problem. He just presents his position as being “for the children” and Kennedy will probably feel compassion and vote for him. Roberts and the extent of his venality or perhaps fear for his family also works for Obama.
No authority to rewrite laws; if he gets away with it then he has the power to do it and, alas, so do subsequent presidents if there are subsequent presidents.
I love the point you made regarding the status quo maintaining until political pressures build (when things are done Constitutionally). I’ve never seen that concept stated with so much clarity. Thanks.
