Federal Court Ruling Against Obama Amnesty Could Break Democrat Blockade of DHS Funding Bill

Before a federal judge in Texas ruled President Barack Obama’s executive amnesty unconstitutional—and ordered its implementation immediately halted—Senate Judiciary Committee subcommittee on Immigration and the National Interest chairman Sen. Jeff Sessions (R-AL) said such a ruling would mean Democrats must stop obstructing the passage of the Department of Homeland Security (DHS) funding bill.

“I think it would have a huge impact,” Sessions told the Huffington Post last week about such a ruling. “I would think it would be further proof that the president overreached and shouldn’t be funded, and it would cause the Democrats to re-evaluate their obstruction.”

Other conservatives, like Rep. Tim Huelskamp (R-KS), echoed Sessions’ statement.

“I think it’s a great opportunity for the Senate Democrats to actually allow our bill to move forward,” Huelskamp said last week. “There should be no concerns to them if the courts are saying this is not going to be implemented.”

On Monday night, Judge Andrew S. Hanen of the federal district court in Brownsville, Texas, ruled that Obama’s executive amnesty is unconstitutional and issued an injunction immediately halting its implementation.

“The court finds that the government’s failure to secure the border has exacerbated illegal immigration into this country,” Hanen wrote in his opinion. “Further, the record supports the finding that this lack of enforcement, combined with the country’s high rate of illegal immigration, significantly drains the states’ resources.”

I agree with your comment that Mitch will cave big time. The Dems will not give up their position in backing Obama. Obama is grinning his big smile knowing that his destruction of America continues on pace!

I believe politicians will do what benefits them. The Dems will gain nothing for their voters- or more importantly their donors- by filibustering or vetoing now.

OTOH neither will the GOP now gain anything by insisting on denying funding for the amnesty, since it will be stayed by the courts!

I still think this is a premature claim of victory, as much as it moves in the right direction. Nothing is settled, only delayed.

We who are footing the bills and want to protect US sovereignty are the "bad guys" according to the conventional thought.

The Perry Syndrome: Candidates hoping to win by flaunting their self-serving "superiority" are doomed to failure.

They need to figure out that its not how much voters like candidates.......it's how much the candidate appears to like voters.

That's the same argument the Democrats are using against Roy Moore and his attempt to block gay marriage in Mississippi. Are the Dems right over that, too?

From his handling of the DHS funding bill sent over from the House, it seems like Reid is still in charge.


Why do you say that? The Founders deliberately set up the Senate to make it hard to pass bills. In their wisdom, they realized that slowing down the process allows the heat of the moment to pass so that people can think about what they are doing.

The only way McConnell could get this past a RAT filibuster is to invoke the nuclear option and get rid of the filibuster altogether. I think that would be as dangerous as having Obama run roughshod over the constitution.

The RATS think that they will not have to pay at the ballot next election for their obstruction and that remains to be seen.

I also do not trust McConnell and he might maneuver to put more pressure on them but there is no smoking gun to prove that he is colluding with the RATS. AFAIK he is getting the Pubbies to vote with him and on that he is doing his job. If the cloture vote were closer, I think there is a good chance that one or more of the pro-Amnesty Pubbie members of the gang of 8, Rubio, McCain, Flake, and Twinkle-toes Graham would vote with the RATS.
