Oregon judge: taking photos up girl's skirt not illegal

An Oregon judge has acquitted a 61-year-old man who admitted taking photographs up the skirt of a 13-year-old girl as she shopped at a Target store in suburban Portland, lawyers in the case said Friday.

Washington County Circuit Court Judge Eric Butterfield ruled on Thursday that Patrick Buono did not break the law when he surreptitiously took the pictures of the girl in January 2013, said his defense attorney Mark Lawrence.

"He did not deny it and he feels real bad about it too, by the way," Lawrence said.

The girl did not notice his actions, Lawrence said, but another woman in the store alerted officials and film from surveillance cameras later confirmed Buono's act.

Our justice system is broken when pervert like this is allowed on the bench.

That Judge should lose his job at the very least. He must made some threats to spill the beans.

So they let him go.

If not illegal, it would have been detrimental to the cameraman’s had he done this to my daughter.

Seems t'me this article is about one that did both at the same time.

The 'law" is not to correct nor punish nor rehabilitate ... the "law" is to make you a criminal ansd get your money

I’m starting to think I’m not actually living in the USA.

My daughter is 23-yrs old, and if I caught this guy taking a photo up her skirt, I’m pretty sure I’d react violently.

Had I caught him doing it when she was only 13, I imagine I would have ended up in prison.

No way...

Their job is to interpret the law, and not make law.

Don’t tell me there is no such law. That’s horse$hit and you know it.

I don’t know State law, but I can assure you this Judge was not the very person ever in the state to be charged looking up 13 year old skirts.

You must think it’s okay to look up little girls skirts. Why don’t you go ask a COP or a D.A. that question.

Although I question if Oregon possibly has a peeping Tom law that the judge could have thrown at this guy, I also agree with the judge on the basis that Oregon may not have an appropriate law to protect people in such situations. (This is very roughly similar to the Terri Schiavo case.)

So when lawmakers were making laws to stop people from driving while talking on their cell phones, they forgot to likewise make peeping Tom uses of cell phones a crime. I suspect that we’re going to be seeing some peeping Tom laws in the future.
