No plea deal likely in Boston Marathon bombing case

WASHINGTON (AP) — The focus of the Boston Marathon bombing trial figures to be as much on what punishment Dzhokhar Tsarnaev could face as on his responsibility for the attack.

With testimony expected to start later this month, the Justice Department has given no indication it is open to any proposal from the defense to spare Tsarnaev's life, pushing instead toward a trial that could result in a death sentence for the 21-year-old defendant.

In a deadly terror case that killed three people, including a child, and jolted the city, there may be little incentive for prosecutors who believe they have incontrovertible evidence to negotiate away their ability to seek the maximum penalty possible.

"There would be now, in my judgment, no reason for the government to reverse course and not let 12 citizens decide if the death penalty is appropriate," said Larry Mackey, a former Justice Department prosecutor involved in the case of Oklahoma City bomber Timothy McVeigh, who was executed in 2001.

I hope they stick to their guns, and I hope the jury sends this guy to the chair, or I guess I should say guerney.

This is a federal case, correct? And, btw, why is it Federal, because it was terrorism?

He’s young and handsome and he should die for his crimes.

The evidence against him is about as iron-clad as it can get. No way can he be acquitted, though we do run the risk of a rogue star-struck juror forcing a hung jury. The tousle-haired terrorist does have his fans, sad to say, and one might sneak onto the jury.

Hopefully not and we are able to convict and carry out the proper sentence without too much delay.

Assuming a conviction with Boston area jurors, I can see Obola pardoning him on what should be the last day of his administration. Make that commutation. That way, the guy can recruit in prison.

Well, that, and the outrage will be the second sweetest music to BHO's elephant ears, not to mention taking some of the attention away from his successor.

Yeah, and maybe his sentence should be to be thrown from a high building onto a spiked iron fence. And left there til the crows come for his miserable eyes. You come to this country for sanctuary, you live off of this country’s beneficence, and you repay us by callously murdering and maiming innocents, including children. He is excrement, like his thankfully late brother, that simply came out of the wrong orifice of his pig mother.

If a criminal in a case like this gets a presidential pardon, he’s going to end up facing state murder charges anyway. The president can only issue a pardon for Federal crimes.

In a sane world. But you're talking about MA justice. Not known for doing the right thing in applying the law in a way that serves either justice or society.

Look at last week's I-93 Massholes that were released without bail. They caused a lot of people inconvenience, lost wages, potential deaths, health issues, etc., and the state judge wouldn't impose even a token amount of bail.

I'm sure "Double Jeopardy" will be applied in the bomber case, not to mention a pardon generally comes after a conviction.

That would be the day Obama also announces that he has evolved toward Islam. Nyaaaah, nyaaaaah, the Presidential Pardon Power is absolute.

I've heard of more far-fetched things. It is unlikely, but would be historically great theater. If he does this, his guard should treat him to a Lee Harvey Oswald experience.

That’s the least of our, and his, problems. He’ll be able to afford it. How much do you think he’ll charge per speech on the lecture circuit? How much will an hour of verbal abuse from Mooch cost? They’ll be as rich as Clintons.
