House GOP releases details of the plan to fight Obama’s executive amnesty

It looks like there will be a fight in February over President Barack Obama’s extension of legal status to millions of illegal immigrants.

This week, two bills submitted by House Republicans were filed in which plans to use appropriations for the Department of Homeland Security in order to forestall or prevent entirely the implementation of the president’s executive order were laid out. On Friday, the House Republicans settled on a plan.

According to reporting, the House plan will fund DHS through the rest of the fiscal year while also preventing further executive action by the president. The House GOP plan also reverses his executive action of 2014 and undoes Obama’s 2012 executive order creating a program that allows the children of illegal immigrants to apply for deferred deportation (Deferred Action for Childhood Arrivals, or DACA).

The emerging plan blocks funding to carry out the directives outlined by the Obama administration in its immigration executive actions last November, as well as the 2012 program Deferred Action for Childhood Arrivals and the 2011 memos, called the “Morton memos.”

It revives the federal enforcement program Secure Communities, and it forces state and local officials to comply with so-called ICE detainers, in which Immigration and Customs Enforcement asks local law enforcement agencies to keep an immigrant in custody, even if they would otherwise be released.

It also significantly reins in how the administration can use so-called parole, which is discretion on which immigrants to allow into the United States. The proposal is backed by groups that push for tougher enforcement of immigration laws, such as NumbersUSA and Federation for American Immigration Reform.

“House Appropriations Committee Chairman Hal Rogers (R-Ky.) said earlier in the week that he hoped to release the DHS funding bill on Friday and have it on the floor next week,” The Hill reported. “Senate Majority Leader Mitch McConnell (R-Ky.) said Wednesday the Senate would consider the funding in February, and promised the department would remain open.”

The apparent decision to target not only Obama’s executive amnesty but DACA could make it harder for Senate Republicans to secure the votes of the six Democrats they need in order to get to 60 and send a measure to the president’s desk, where it would invariably be vetoed. It goes without saying that this move will make it impossible for Republicans to net bicameral majorities robust enough to override a presidential veto.

It is unclear, however, that Democrats will be all that eager to prevent Republicans from trying to use a fight over DHS funding to blunt the president’s actions on immigration. According to a letter circulated in the House by Rep. Joaquin Castro (D-TX), Democrats see a political opportunity in attacking the GOP over setting the stage for “another manufactured crisis.”

“Gaming the appropriations process and using the Homeland Security funding bill as a way to defund the President’s immigration executive order is a political shot that misses the mark and puts our nation at risk.”

Democrats, and their allies in the press, will seek to make the case that Republicans are willing to sacrifice national security in order to prevent extending legal status to illegal immigrants. Even if an impasse over Obama’s immigration order leads to a partial shutdown of DHS, though, it would have a negligible impact on national defense.

Roughly 85 percent of DHS employees continued to work during the October 2013 shutdown for those reasons, according to the Congressional Research Service. For employees whose jobs were considered essential – or “necessary for the preservation of the safety of human life or the protection of property” – their paychecks were withheld until the shutdown was over.

U.S. Citizenship and Immigration Services, the agency that will implement the heart of Obama’s executive actions – deferred deportations and new work permits for potentially millions of undocumented immigrants – is almost entirely fee-funded, so its staffers will continue working right through a shutdown.

If this measure fails to attract the six Democrats it needs to pass the Senate, it will be up to the upper chamber to craft a bill that can. Republicans have, however, set the terms for negotiations at a place that should be favorable to conservatives. They will not get all of what they have asked, but it sets the stage for a fight in which many believed the GOP would decline to engage.

They are great at diversion since critical thought has been removed for a few decades now, from every school on the planet.

Can’t imagine why that happened. On the bright side, our chocolate ration has been increased from 50 grams to 20 grams.

I looked up “Secure Communities” on the ICE website and they lowballed the figure at 10 Million, said they obviously cannot do the job of enforcement, and have come up with a much more “common-sense” figure of 368,000, which is not the same thing at all.

In a major suck-up to illegals, Oboma "announced" he was issuing an
E/O and planned a "signing ceremony" at a Las Vegas gathering of
illegals. E/O and signing ceremony nevah happened.

Obama was photoed signing "memos" on AF One---not an "executive action." Why? B/c an E/O comes w/ legal baggage that the conniving Boobamba wanted to evade. Both "memos" are now on the Whitehouse website.

The scam works this way: signed Boobamba memos "delegate" to federal agencies orders to come up with plans (that must advance Boobamba's global conspiracy to overthrow the US govt w/ Third World federales and their cadres jumping the US border).

The federal agencies then "invent" Committees to do this (the better to overthrow the US govt). Then "Administrative Rules," after a comment period, will be published in the "Code of Federal Regulations," which magically turns them into law........ using federal fairy dust.

So Boobamba is shielded from responsibility---he doesn't have to take the hit. Behind closed doors, he tells federal factotums what he wants.....and faster than you can say "the combo plate w/ extra hot sauce".....the overthrow of the US govt commences.

THE "DELEGATION" HORROR STORY--A Federal agency MO since 1946. It's down to a science: (1) publish a Notice of Proposed Rulemaking (NPRM), (2) make the comment period really short, (3) stonewall any negative comments, and, (4) publish the rule, which (5) NOW has the force of US law. No Congressman was ever involved, and Boobamba doesn't leave his DNA on it. The judiciary has consistently ruled against the nullification doctrine, asserting its unique, judicial right to declare laws unconstitutional. But this executive order isn’t a law. And given its extremely shaky legal footing, it isn’t difficult to imagine a federal bench recognizing the states’ right to disregard federal orders that don’t clearly have the force of law.

And that would be a tremendous — tremendous — blow against the executive’s assumption of legislative powers.

But in the shorter, more direct term: It would force the Obama administration to go on offense, perhaps suing the states to enforce a law........ that isn’t a law.

AS OF TODAY---25 states have joined in the nullification action.

The Obama administration has issued new exemptions to a law that bars certain asylum-seekers and refugees who provided “limited material support” to terrorists who are believed to pose no threat from the U.S.

The Department of Homeland Security and the State Department published the new exemptions Wednesday in the Federal Register to narrow a ban in the Immigration and Nationality Act excluding refugees and asylum seekers who had provided limited material support, no matter how minor, to terrorists.

“These exemptions cover five kinds of limited material support that have adversely and unfairly affected refugees and asylum seekers with no tangible connection to terrorism: material support that was insignificant in amount or provided incidentally in the course of everyday social, commercial, family or humanitarian interactions, or under significant pressure,” a DHS official explained to The Daily Caller.

In the category “Presidential Documents” at page 70769, Obama ordered a White House Task Force on New Americans to “engage with community, business, and faith leaders, as well as State and local elected officials.” The task force is designed to “help determine additional steps the Federal Government can take to ensure its programs and policies are serving diverse communities that include new Americans.”

The second of the presidential actions entitled, “Modernizing and Streamlining the U.S. Immigration Visa System for the 21st Century,” filed Nov. 26 in the Federal Register at Vol. 79, No. 228, in the category “Presidential Documents” at page 70765 (http://www.gpo.gov/fdsys/pkg/FR-2014-11-26/html/2014-28191.htm).

This empowered the secretaries of State and Homeland Security, in consultation with the director of the Office of Management and Budget, the director of the National Economic Council, the assistant to the president for homeland security and counterterrorism, the director of the Domestic Policy Council, the director of the Office of Science and Technology Policy, the attorney general, and the secretaries of Agriculture, Commerce, Labor and Education.

The order was to make a series of recommendations “to reduce government costs, improve services for applicants, reduce burdens on employers, and combat waste, fraud, and abuse in the system” of issuing immigrant and non-immigrant visas.
