I say this as someone who has never had a drink ever in the 46 years I have been around. It is clear when a person decides that they are to drunk to drive so they sleep in their car at the bar. If they turn it on to stay warm they are ticketed and run threw the money making system. I personally find this disgusting. In essence it says go ahead drive home because we will get you either way.

I've gotten arrested for this twice (car not even on, just sleeping in it). One time I slept in my car (on a side residential road), and got a PI for it. Luckily the DA gave me a deferred dismissal so no record and only cost a couple hundred... The other time I had my pistol in the car so they threw a unlawful carry on me (No PI, no DUI) and now I've been waiting a year and a half for them to file the case... Which they did, and now I gotta start fighting it.

Like you said, I'm learning my lesson. Just drive home half-drunk, and you'll get the same result, only less of a chance to be caught.

I know a couple people who have had this happen to them. Again, it was what "could have" happened, not what did happen. The Cops and DA (in your case, kudo's for the dismissal) are acting as soothsayers reading a future that never even took place all with laws provided them by politicians enacting feel good legislation and fleecing wallets along the way.
