Oklahoma, Nebraska suing Colorado over legalization of marijuana

OKLAHOMA CITY – After legalizing the recreational use of marijuana, Colorado is at the heart of a lawsuit.

The Denver Post is reporting that Nebraska and Oklahoma have filed a lawsuit with the U.S. Supreme Court, asking the justices to strike down Colorado’s legalization laws.

The Colorado attorney general’s office says the lawsuit alleges “that Colorado’s Amendment 64 and its implementing legislation regarding marijuana is unconstitutional under the Supremacy Clause of the U.S. Constitution.”

“Because neighboring states have expressed concern about Colorado-grown marijuana coming into their states, we are not entirely surprised by this action,” said Colorado Attorney General John Suthers. “However, it appears the plaintiff’s primary grievance stems from non-enforcement of federal laws regarding marijuana, as opposed to choices made by the voters of Colorado. We believe this suit is without merit and we will vigorously defend against it in the U.S. Supreme Court.”

Oklahoma Attorney General Scott Pruitt issued the following statement about the lawsuit:

“Fundamentally, Oklahoma and states surrounding Colorado are being impacted by Colorado’s decision to legalize and promote the commercialization of marijuana which has injured Oklahoma’s ability to enforce our state’s policies against marijuana. Federal law classifies marijuana as an illegal drug. The health and safety risks posed by marijuana, especially to children and teens, are well documented. The illegal products being distributed in Colorado are being trafficked across state lines thereby injuring neighboring states like Oklahoma and Nebraska. As the state’s chief legal officer, the attorney general’s office is taking this step to protect the health and safety of Oklahomans.”

Sounds like he was using the St Foin variety for medicinal purposes.

Most N American areas can grow 3x harvests of industrial hemp per year, only the last harvest goes into seed/flower. Planting the St Foin early meant he was wanting the biggest flowers possible on them. This is NOT an industrial usage planting schedule. It is a maximum bloom planting schedule.

I no desire to control what other people do. I have a full time job controlling what I do. Maybe I’ll get to that mote if I ever finish removing this beam.

Kind of interesting how many want Colorado to return the bit of sovereignty it took to the Feds because they don’t like that it was marijuana. I say that the more States that defy the Feds, in about any way, the better.

According to an Associated Press story, about four-fifths of the states now have local laws that reject or ignore federal laws on marijuana use, gun control, health insurance requirements and identification standards for driver's licenses. Kansas Gov. Sam Brownback recently signed a measure threatening felony charges against federal agents who enforce certain firearms laws in his state.

Exactly - far too many here have no idea of what it is to be true to the Constitution. Hard as they try to portray themselves as constitutional conservatives, they always seem to be finding areas where they “reason” that it’s OK to keep bolstering the power of the Feds over strict Constitutionality because something piques their dislike button. God help us.

They’re Nanny Staters, plain and simple. What astounds me is when they bitch and moan when the State takes the weapon that they gave it and uses it on them (for tobacco, soda, fatty foods, etc.). I mean, really, it doesn’t get and dumber than that.

Other than one I hear on the Denver station 710 some time back, no I don’t.

I don’t remember the numbers, but it was a significant margin for repeal.

It appears I upset a few amateur Constitutional scholars with my comment yesterday, and I forgot to use /sarcasm. I was recalling an experience from my time in Germany, when we had distinctive green plates on our cars.

The German polizei just knew I was a drug dealer, because there was no way a 25 yo GI could afford a new Volvo. He spent an hour searching my vehicle, obviously to no avail.

LOL! I know it might be a coincidence, but really out on the highway I drive home on there were a lot of Colorado plates pulled over this summer.

As far as upsetting people on this forum, we are FReepers, its what we do. :)

Of course no other state has a single gram of weed within its borders. The cartels do not sell illegal weed in OK or Nebraska. Marijuana does not exist outside Colorado.

Drug warriors are identical to gun grabbers. Immune to fact and logic.

Good thing you were only almost willing. You would have bet wrong.

If you had paid attention, you would have seen that I did not have the time or inclination to write a definitive list of laws.

But, as long as you threw it out there, while I am not in the least a proponent of gay marriage, I think government should get out of the marriage business altogether.

Marriage is a church institution and none of government’s business. I’m fine if the government has no stance on it at all. The only reason it is an issue is that a bunch of people want government benefits under the umbrella of “marriage”. If there were no economic incentive, they wouldn’t be bothering with it.

Is that was God created marriage for? To get tax breaks? I kind of doubt it.

Nope. Once the concept that the government can control your ingestion is in place then they can control you completely.

Why stop at some chemicals? Why not allow government to control your salt, sugar, and fat intake? And if it is for you and everyone else’s good then exercise becomes mandatory.

Think I am kidding? I am not. Part of the ObamaCare plan is to require physicals every year with prescribed diet and exercise since your health can adversely affect the cost and availability of medical care.

Let’s put this another way. If you cannot control yourself and your children do you really think other people, read: government, can? Somehow what you fail at others can succeed?

It hasn’t worked yet. Every kid in high school can get pot.

(Unconstitutional) asset forfeiture laws.

For an entity that is very critical of profit motive in the private sector, the government’s propensity for greed and ill gotten gains is enormous.

Nobody has mentioned the United Nations or international law yet. The UN passed anti-cannabis laws making the cultivation and sale and possession of cannabis illegal in all UN member states.

Yet here we are, the country that pushed these international laws, growing and selling pot in several states! When do you think the UN will sanction us, like we sanctioned Panama (and invaded them, captured their leader, and tried him in the States)?
