Depends. Is Marquette a public or private school?

I think it is a private Catholic (Jesuit) university.

That private distinction has never stopped the government from exerting authority over any school that receives government money in any fashion. Which is why Hillsdale refuses government money.

I’m sure that in this case the powers that be suddenly won’t think that they have the right to interfere in a private school, unlike when they leaned on Bob Jones University for its dating policy a few years ago. BJU is also a private, religious university but unlike Marquette it’s decidedly non-progressive and therefore deserving of government regulation.
