Visiting soldier can't stay in wife's Central apartment, landlord says

CENTRAL, SC (FOX Carolina) -

A soldier returning home for the holidays to see his wife and newborn baby in Central is being kicked out of his wife's apartment after the landlord said he is overstaying the time allowed for visitors.

Sergeant William Bolt is stationed in Missouri, but his wife has been in Central. She gave birth to their daughter two weeks ago.

Bolt said the landlord at The Groves apartment complex in Central told him he had overstayed, saying visitors are not allowed to stay in the apartments past seven days, per the agreement signed by Bolt's wife, Lily. [snip]

On what basis? On the basis that even renters have rights to the space they rent.

Cite your own law if you want to go to court.

How about the Soldier’s Civil Relief Act—TITLE III – RENT, INSTALLMENT CONT
RACTS, MORTGAGES, LIENS,
ASSIGNMENT, LEASES
§ 531. Evictions and distress
[Sec. 301]
(a)
Court-ordered eviction.
(1)
In general. Except by court order, a landlord (or another person with paramount title) may not—
(A)evict a servicemember, or the dependents of a servicemember, during aperiod of military service of the
servicemember, from premises—
(i)
that are occupied or intended to be occupied primarily as a
residence; and
(ii)
for which the monthly rent does not exceed $2,400, as adjusted
under paragraph (2)
for years after 2003;
or
(B)
subject such premises to a distress during the period of
military service.

From what I read, this lady should be able to have her husband visit and stay in her apartment as her roommate.

On the basis that I’ve owned rental property before. Renters have rights especially when its a married couple.

Don’t have to like all of their protections but they have em.

Take your games somewhere else, this is an informal forum not a court of law.

Right—and even as screwed up as our court system is, I can’t think of one that would allow a landlord to evict, or raise the rent, of a dependent who allowed her HUSBAND to visit her for longer than 7 days.

Again, I ask you to state that right.

As I understand your post, you realize that the law does not apply when you have no basis in law to support your position?

Happens all the time. Roommates have boyfriends move in or get married and move their husband in against the wishes of the other roommate.
