Cop cleared in chokehold death of Eric Garner

A Staten Island grand jury cleared an NYPD cop in the chokehold death of Eric Garner during his caught-on-video arrest for peddling loose cigarettes, the Staten Island district attorney confirmed Wednesday.

The panel voted a “no-bill” and dismissed all potential charges against Officer Daniel Pantaleo.

The blockbuster decision capped weeks of investigation by the special grand jury, which was empaneled in September specifically to review evidence in Garner’s racially charged death.

In a statement released by his union, Pantaleo said: “I became a police officer to help people and to protect those who can’t protect themselves.”

“It is never my intention to harm anyone and I feel very bad about the death of Mr. Garner,” he added....

This is a real case of police abuse IMHO... I am waiting to see the evidence presented to the grand Jury that could change my mind

the guy broke up a fight ... i’m not sure why the officers felt the need to subdue him and choke him out.

what exactly were they ordering him to do that he wasn’t complying with? and did he need to comply?

this one stinks to high hell ... it was inadvertent, but looks like manslaughter to me. this did not need to happen

It wasn’t a chokehold death, despite the headline.

The justice system did its job and the Grand Jury, which actually looked at all the evidence rather than reading a few slanted news reports, made its decision.

Move on or riot, whatever.

I tend to agree. I’m a supporter of the police in most of these cases, but watching the video, this one is pretty questionable in my eyes.

The guy had a heart attack. He'd been arrested before. The conversation starts out...You guys leave me alone..

Maybe he shouldn't have been doing what he was doing.

That cop was subduing him....not trying to kill him. Geez...

The jury got it right.

The Grand Jury, who not only saw the same video but heard ALL of the evidence, disagrees.

Though its a tragedy for the man's family, the whole thing started when Mr Garner resisted arrest.

Seems to be a common theme lately.

Just so sick of it all. It’s sad to be sure, but how come this stuff doesn’t go on out in good old hardworking middle class America? It’s because people just friggin’ know how to stay out of trouble.

I’m just in no mood for all the hype again ... Would rather tune into Hallmark Christmas stories....or Pinterest or something .... Just need a dam break from all this crap .... It’s al

Yes, you need a license and have to pay taxes on cigarette sales. It’s to protect minors and make sure the government is getting its cut.

I’ll play devil’s advocate here:

This guy Garner had a rap sheet a mile long. 30 arrest for the same thing. He knew the drill but in this case he says “It ends today” and resists being cuffed. He’s a massive dude 6’3 350lbs. Cop throws him in a hold that is technically not a “chokehold” more of a half choke. The whole time Garner is saying “I can’t breathe.” Well if you can talk, you can breathe. The “chokehold” is applied for at most 15 seconds. After that the other cops are one the guys back. I would have more of a problem with the way they cared for him well after he was subdued and on the ground. That was the real mistake. IMO the coroner was pretty irresponsible calling this a homicide. It’s pretty obvious that there is plenty of reasonable doubt that the “chokehold” negligently caused this man’s death, much less intentionally murdered him as the activist crowd is screaming. Prosectutor don’t seek indictments on case they can’t win so no surprise he was not indicted. The only real reason to aggressively seek an indictment is to prevent riots, but we know the rioting types don’t really care about facts or logic anyway.

He had a heart attack, which was brought on by compression of his neck. There is a concept in the law known as the “eggshell skull” rule, which means that you are responsible for any injuries caused by your actions, even if the injured person is unusually susceptible to injury or sustains injuries that are unusually severe in relation to your actions. So, the fact that he had other medical problems doesn’t (or, rather, shouldn’t, under the law) absolve the officer of responsibility.

Well, gee, I guess capital punishment on the street without benefit of a trial isn’t cruel or unusual anymore for selling contraband cigarettes.
