What happens to all pending LEGAL visa applications then?
Immigration Service is self-funding via fees. Except for a few small portions, theres no appropriated money going into it. So when the gvt shut down last year it was exempt from the shutdown and stayed open.
So the default position for it is “open”, and it would only close if the President ordered it closed. Or signed a bill ordering it closed.
The only working option would be to sneak a provision into the CR directing immigration not to purchase or create green cards above FY14 levels. Then dare the President to shut down the entire government over that one clause.
