Oklahoma, Texas AGs Plan to Sue Obama over Executive Order on Immigration
National Review ^ | 11/21/2014 | Andrew Johnson

Posted on 11/21/2014 6:51:11 AM PST by SeekAndFind

Oklahoma attorney general Scott Pruitt announced prior to President Obama’s speech, in which he said that he will grant legal status to immigrants in the country illegally, that the state will bring forward legal action. Pruitt released the following statement:

It is anticipated tonight’s speech will again prove our President sees himself as above the law. Regardless of what the President thinks the law ought to be, our constitution dictates that Congress makes the law, it is the Presidents duty to faithfully execute those laws. If the President takes an executive action that violates his constitutional duty to faithfully execute the immigration laws passed by Congress, we will take action to hold him accountable.

Following the president’s speech, Texas’s attorney general and governor-elect Greg Abbott vowed to do the same.

President Obama has circumvented Congress and deliberately bypassed thew ill of the American people, eroding the very foundation of our nation’s Constitution and bestowing a legacy of lawlessness. Texans have witnessed firsthand the costs and consequences caused by President Obama’s dictatorial immigration policy and now we must work together toward a solution in fixing our broken immigration system. Following tonight’s pronouncement, I am prepared to immediately challenge President Obama in court, securing our state’s sovereignty and guaranteeing the rule of law as it is intended under the Constitution.

I don’t hold much optimism for a successful lawsuit. Robert will punt responsibility by declaring it a “separation of powers” issue precluding Court review.

Yay. It’s hard to believe he thought he could get away with doing it and have no blow-back. He probably knew but had no choice after he goofed and made the promise to go rogue to the special interest groups I guess.

Well hell yeah. The massive immigration that’s going to ensue is going to cost a LOT of money to pay for increased border patrols and administration, welfare, healthcare and eucational subsidies, increased jail capacity and funds to expedite the illegals to jails where they already have warrants down near the border, roadwork to widen the roads for the influx of illegals, etc... The list could go on and on. He’s going to increase our tax burden and our property taxes will go straight through the freakin’ roof but what does he care because he’s a multimillionaire and will probably be a billionaire by thetime George Soros pays the rest of his bonus money for accomplishing the mission goals he laid out for him!

As with most lefties, I don’t think he even considered the potential ramifications. He wanted to “get back at” the voters who soundly rejected his policies (remember, he said those policies were on the ballots). Just like Jarrett said about the 2012 election, after they won it would be “payback time” to punish those who stood against them, this is “payback” for 2014.

Anyone serious about mounting a legal challenge to Obama should have had the paper work and lawyers sitting there and ready to go the minute they had the details from Obama.

With all the money and power available to the Republicans you would think they would already have a judge lined up to slam an injunction on Obama the minute he finished his speech.

That’s what liberals do.

Well this sounds good and I applaud them for trying but there is likely no court that will give them standing. Only a member of Congress would have any chance of succeeding with a lawsuit. Lawsuits drag on and on. The Congress needs to just do what it can to disrupt all this stuff Obama is trying to do by defunding here and there and screwing with his nominees. Make sure no more lefty judges get appointed to the Federal bench etc. Jam the Keystone Pipeline through and dare the POS to veto it.

If they are not going to impeach and remove the guy then they need to just make him irrelevant. That’s what Obama fears most.

Instead we see and hear mild ‘oh, we’re going to do SOMETHING’ reassurances from our side, and in the meantime, NEW illegals are running for el Norte as fast as they can.

The chamber of commerce won.

And take note -— Obama didn’t exactly grant amnesty to millions of illegal aliens. He just said that henceforth the government wasn’t going to do anything about enforcing the law. Worried about being deported? Relax. “All we’re saying is we’re not going to deport you.”

The States who sue will have a strong case in court because it is clearly who REFUSES to enforce the law he swore to uphold.

It was called SHAMNESTY back when George "Dubya" Bush suggested something similar.

Effectively it may be de facto amnesty but it hasn't changed one law on the books. To me it seems that the true legal status of the illegal aliens remains unchanged.
They are still illegal aliens according to the laws on the books.

As far as the law itself - I believe there is a law on the books prohibiting illegal aliens from being employed.

So this would place potential employers in a quandary - Obama gives the illegals a green card and says "Give them jobs". But anyone employing them would also be directly violating an extant law.

I'm sure that Obama never considered that his order might open employers of these "forgiven" illegals to legal action.

But it follows that an employer might also file a lawsuit against Obama for ordering them to employ illegals in violation of a standing law specifically prohibiting it.

The Spanish news TV station Hecho had a scrolling banner at the bottom last eve reading “Texas reduces number of soldiers at Mexican border for 2015” and also spotlighted the amnesty application website http://iamerica.org

Thought y’all should know.
