I agree on ex post facto.

Some states have 3-strike laws, which have been contested as too harsh—as when the third offense is some minor shoplifting offense that results in a life sentence. While I doubt that happens very often, maybe 3 is low—but this guy should have been in an institution for the mentally incompetent. Now, he’s graduated to meet the acceptance requirements in an institution for the criminally insane, which will no doubt form the basis for his legal defense.

Judging from the threads on the guy feeding homeless down in Miami this guy is just one of the downtrodden. We should have sympathy for him.

NYPD arrested him, each and every time.

A JUDGE freed him, each and every time.

I was thinking much the same thing. I’d lay money Darden has a long history (documented or not) of mental illness and psychotic behavior.

According to the Supreme Court, the police and the government have NO responsibility to keep you safe. It's a group thing, not an individual thing. Sorry.

Yeap, I recall my brother who was a CEO of a Mental Health facility in Il. telling me many times it was out of his hands if patients did not want to get treatment.

He actually lost one of his patients to Jeffrey Demer.

Another time he went out in the middle of the night with a priest to talk the homeless in the city, to seek shelter when the temps where below 0.

When/if they catch him, “death”. Solves lots of problems. For example, his rap sheet will not get any longer, he will no longer be a danger to society and he will no longer be homeless. I can think of more but you should get the idea..........

Our Constitution provides for impeachment of judges, does it not. Or perhaps the politician that gave them their directions?

True. I don't care why a dog attacks, as long as it gets stopped.

Black guy murders a random Asian guy, and there’s no discussion of whether it might have been a hate crime?

Blacks are incapable of being racis.

Do try to get caught up.

It’s not the police dept. It’s the judicial system.

Its neither, or both. its the culture of NY City.

Still, redemption is possible. At one point 60% of the people living under my roof were convicted felons. They are all now productive citizens, all have jobs, two are married, and one a rising star in his company.

Not the way to bet though...

Oh, and as an aside, I've never been convicted, never charged, never arrested, never detained, never accused.

I was a person of interest once, as a witness. And I've had two moving violations in 45 years of driving, so my life isn't completely dull...

“Can/should the family sue the NYPD?”

They could, and no doubt will, sue the city. But the NYPD arrested the guy, that’s their job and I guess they did it 30 times or more.

In terms of trying, convicting and imprisoning him, etc. that’s up to the DA and the Courts.

Now I sound like the beginning of “Law & Order”

But, he’ll be good for a long stint this time.

"The NYPD has identified a homeless man, ..."

Why is this poor man being condemned for what he did? He's Black and Homeless. He's a SAINT in the eyes of Obama and his Democrats. He can't do anything wrong! The Poor, Homeless, Black man was only expressing his pride in his race and the superiority of his Poor, Black, Homeless Urban culture. He is a true Son of Obama and the Democrat Party!

Why was this guy not in jail?
The hard core progressives believe that no one should be in jail note how California is releasing so many it’s just a matter of time.

Since poverty obviously causes crime, the city needs to give this guy a big raise in his homeless salary.
