A graduate student has sued a textile company for refusing to hire her for a two-month internship because she uses medical marijuana to treat frequent and debilitating migraine headaches, a decision her lawyer calls discrimination.

Christine Callaghan, who is studying textiles at the University of Rhode Island, sued Westerly-based Darlington Fabrics Corp. and its parent, the Moore Company, on Wednesday. The Rhode Island chapter of the American Civil Liberties Union, which is representing Callaghan, said it believes it's the first lawsuit of its kind in the state.

It was obvious these types of lawsuits were going to happen.

Basically, it’ll breed a new concept of THC testing, and they will call an employee into the office at 8AM....run a random test, and if you have a THC level of being doped-up...they fire you then.

I agree, it’s going to breed tens of thousand of lawsuits over the next decade. Some companies will just pay off an employee with $10,000 just avoid lawyer costs.

Ah, she just has a doctor’s OK, not a prescription.

She has no case because a company would refuse to hire anyone taking a prescription medication that could interfere with job performance.

Some big companies are now taking hair samples along with a pee test for drug use.

Marijuana use is still a Federal crime. Case dismissed.

Federal law still has it listed as an illegal drug, right?

Can’t wait till the next President comes in and declares that he will begin enforcing law again.

“Here we go!”

Exactly. I was wondering how this would be handled, I think the idea is to restrict employers from prohibiting the use of pot alltogether. Next thing you know the company smoke shacks will be filled with people using bongs.

Yep. I suspect this is the beginning of the end for pre-employment drug testing.

“Pray, does she have a prescription?”

I imagine everything is in order, it’s probably been planned knowing what the company would do so it would be made a court case, that’s the whole intent.............Just a guess though.

The point is that companies don’t want people that are not in peak condition to perform because there is a liability issue at stake. The need for prescription pain relief medication indicates a definite weakness.

At the company where my husband worked, a worker on prescrition oain relief medication is told not to come back to work for five days after he stops the medication.

Tough choice... hire a chronic marijuana smoker or a person who is likely to have absentee issues from "frequent and debilitating migraine headaches."

What to do... what to do...

And yet companies can fire employees who smoke tobacco even in their off-hours.

Can the federal government use RICO statutes to loot the cash reserves of states that are profiteering from recreational dope?
