The prosecutor's argument will be that the possibility that Martin was Black led Zimmerman to pursue him, and that Martin, fearing Zimmerman's intentions, attacked first. Having a gun, Zimmerman knew that if he provoked such a hostile reaction from Martin, he could bring any incident to a fatal conclusion for Martin.
Personally, I think that is a crock, but federal courts and judges tend to be friendly to the prosecution.

He would have had no assurance of the outcome, or even whether he (Zimmerman) would survive the confrontation.
On the other hand, we have the delicious irony that Martin thought he was pursuing a "queer-ass cracker" and was about to deliver a "thumping" to a white gay man on the encouragement of his girlfriend.
So the Feds are going to prosecute the victim of civil rights abuse using the same law that gay-bashing Martin violated prior to his death.
So typical of Bizarro World justice when the Left is in power.

Additionally, the prosecution will leave out certain mitigating facts, including Zimmerman's 9-11 call where he can't readily identify Trademark's race, that Trademark doubled back, etc.
There was an interview a couple months back with that friend of Martin's who's performance on the stand completely backfired. It's clear that she's spent time with a language coach.
