“I fail to see how this was a victory for the IRS. They gave the tax exempt status to get out of the case.”

Let me help you out here. You see this sets the precedent
that denying is just delaying indefinitely. Now they can do
it again and all they have to do is delay the trial until
after the election then grant the tax exempt status and
they are off the hook. No one was held accountable and as
far as this ignorant judge is concerned no harm done.
Victory? The IRS can disenfranchise and deny voters their
first amendment right at will, well at least delay it.

..........as most freepers know, perhaps all, there are 3 branches of government. They are the judiciary, legislative and Executive.

This fight as the judge saw it was a fight between all 3 branches. Basically he is saying, as the representative of the judiciary..........”hey legislature!......do your job and rein in the IRS (Executive Branch)! Don’t leave it up to me!”

I don’t agree with his decision because these people were clearly abused and damaged. So, I don’t think HE did HIS job. But, I do think that or something close is what he was thinking.
