One Last Hurrah for Texas Voter ID

Overnight the Supreme Court refused to reverse the stay imposed by the Fifth Circuit Court of Appeals and thus allowed voter ID to be required in the mid-term election in Texas. This is procedural delay based on the idea that election rules shouldn’t change at the last second.

So voter ID gets one last hurrah in Texas.

But election integrity advocates shouldn’t celebrate too much. Texas Voter ID is doomed. After this next election, it is prohibited from being used.

Nor should much faith be placed in any appeal. The plaintiffs won on two separate theories under the Voting Rights Act, and both are fatal to the law. First, the court ruled that Texas voter ID was enacted with a discriminatory intent. That finding alone dooms the law. And here’s the bad news: the chances of that finding being overturned are next to zero. Proving discriminatory intent isn’t easy, but the court said the plaintiffs did it. That’s a fact-based determination and will not be overturned unless it is clearly erroneous. Appeals courts are deferential to lower courts on fact findings. Why? Because lower courts conduct the trial. Lower courts see the witnesses, even if they sweat and squirm. Appeals judges sitting in New Orleans can’t size up the witnesses like the lower court judge in Corpus Christi.

Second, Texas also lost on the results prong under the Voting Rights Act. The plaintiffs pushed an outlandish theory for sure, and one that might get overturned on appeal. They pressed the novel idea that any statistical disparity of the impact of voter ID dooms the law. If blacks have ID less than whites, game over. The problem is that the courts have so far rejected that idea. You can be sure the Supreme Court will also.

But so what? The intent finding stands and that means that the Texas law likely gets one last hurrah in two weeks.

What’s the solution? For Texas to pass a new ID law lickety split. A new law can be in place within a few days of the Texas legislature convening in January. Pass something identical to the law approved in South Carolina or Georgia, and it’s lights out for the foes of election integrity.

Praying you are right about that. Straus has been like a bedbug infestation on our state legislature. He needs to go.

I don’t know how much help voter ID will be anyway, because the poll workers who are letting people pass as the registered 80 year old when the presenter is clearly much younger than that, aren’t going to look at the photo too carefully either.

When the Austin, TX, fifth-column media skank announced the SCOTUS ruling this morning she referred to it as “controversial.” I’m surprised she didn’t break into a tearful harangue against the ruling.

Hummm!!!Another liberal whistling past the grave yard. There's nothing inherently wrong with having a voter prove he's eligible. There may be sematic changes but it will be up held!!!

Which media skank in Austin? I don’t do ABCCBSNBCMSNBC but I bet it was local latina media skanks on all the locals.

The Left can’t make too big a stink about this because it is their fraud that has made VoterID necessary, and they know it.

LIVers are poised to make that connection, those that think elections aren’t rigged.

As I understand it, the # attached to the photo ID is entered into the voter rolls as you ask for a ballot. Same as with absentee, thank BobL for that info. You have to send a copy of your ID with your absentee ballot request.

We need to make time to do some poll-watching in our ‘suspect’ areas the next few weeks, make RATS realize we’re serious about stopping election-stealing.

Must be a predominantly Republican precinct. Here in Delaware, we’ve had voter ID for years , and there’s never been a challenge to it because the Dems get the result they want anyway.

I think James O’Keefe identified himself as someone in his seventies and was allowed to vote, didn’t he ? I don’t know what state that was though.

It was either the local ABC or CBS station. I can't watch any of them too long at one time without getting a little spit up in my mouth.

Tonight the local fifth-column NBC station talking head showed interviews with only with leftist organizations opposed to the SCOTUS decision. Yet they later pointed out which photo IDs were acceptable; there were many options (some of them free).

If someone can't get an approved photo ID, they are probably illegal aliens, or citizens stupid they shouldn't be voting anyway. Of course, that is why the Demonicrats want to help any of those groups to vote.

University ID's aren't issued by the DPS, and being a student at a university doesn't mean you're not registered to vote elsewhere. There are lots of foreigners who have University ID's who have no right to vote in our elections.

Also I’m not sure why they are not allowing photo ID from state universities. Unless they can articulate a good reason I think they should allow them.

A lot of university's have switched to IDs that look and act like debit card with the magnetic stripes on the back. The pictures on them are small and usually not a very good reproduction of the individual. They really would not make a good and accurate form of identification.
