Holder's deputy said to be preparing resignation

The Justice Department second-raking official is preparing to step down, completing an exodus of top brass from the agency, according to published reports.

Deputy Attorney General James M. Cole would become the third member of the Justice Department’s brain trust to announce his departure in recent weeks.

Attorney Gen. Eric Holder announced his departure in late September, though he has pledged to remain in office until his successor is in place. The White House has indicated that President Obama would not nominate anyone for the position untl after the November midterms.

Associate Attorney General Tony West, the third-ranking DOJ official, stepped down on Sept. 15, leaving the agency to become general counsel at PepsiCo.

As deputy attorney general, Cole has overseen day-to-day operations at the agency for nearly four years.

He was most visible on issues involving data collection and was closely involved with the agency’s response to legalization of marijuana in some states. He has also been vocal about the Justice Department’s willingness to pursue criminal cases against Wall Street banks.

Cole's departure, first reported by The Washington Post and The Los Angeles Times , could not immediately be confirmed with Justice Department officials.

That’s probably what kickstarted it but I bet there’s a lot more. This is the most corrupt administration in U.S. history so I think even more will follow as the realize the Emporer has no clothes...

Yep there’s a lot more.

I’m anxious to see what judge Sullivan is going to do on or shortly after the 22nd. Judicial Watch will be pushing it to the max, this could get real interesting.

Could it be a mere coincidence that these top folks in the DOJ are resigning AFTER Judicial Watch got a judge to rule that information on the gun running program “Fast & Furious” must be released?

In my opinion, any program like that would have had to be approved at the very highest level of the DOJ since it basically was a government plan to break existing law. As far as I know, they knew it was a felony offense because they later convicted one of the gun store operators in New Mexico for following their directions.

In addition to RICO there is another Federal Statute which is right on point: 18 US Code, Section 4

Similar to abetting a felony or obstruction of justice, the statute basically says: “Whoever, having knowledge of the actual commission of a felony … conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States” is guilty of misprision of felony and can be punished with up to three years in prison.

Under the federal statute, the prosecution must prove the following elements to obtain a misprision of felony conviction: (1) another person actually committed a felony; (2) the defendant knew that the felony was committed; (3) the defendant did not notify any law enforcement or judicial officer; and (4) the defendant took affirmative steps to conceal the felony. Precisely what constitutes active concealment is a Question of Fact that depends on the circumstances of the case.

I sent JW a copy of my post and encouraged them to make a big deal of the lawbreaking in their upcoming press release and that they should name names.

If they accuse Holder and his staff of breaking the law, they might get a ripple of interest in the MSM, if only to ridicule JW.

Good job.

Like you I have to believe it was signed off at a high level. Even if it was the number 2 or 3 man I’m sure Holder was at least aware of it.

It’d be nice if it blows open and it’s all over the media but probably too much to hope for.
