A civil suit only needs a 51% likelihood to convict.

No one is "convicted" in a civil suit. The plaintiff in a civil suit has the burden of proving his/her case by a "preponderance of the evidence" which you can try to sum up as a "51% likelihood" but it is really a more nebulous standard when put in front of a judge or a jury.

My point is that this case has nothing to do with the boy. He has gotten all the punishment he is going to get: a 5-day suspension and a brief transfer to a different school.

This is a lawsuit against the school. Whether the girl "consented" or not is only peripherial to the issue before the court.

Absolutely tragic.
