'Humiliated' Dinesh D'Souza seeks probation after guilty plea
Reuters ^ | 09/05/2014 | Jonathan Stempel

The conservative author and filmmaker Dinesh D'Souza has asked a federal judge to sentence him to probation and community service after pleading guilty to a campaign finance law violation.

In a Wednesday court filing, D'Souza's lawyers said their client will present himself as a "disgraced and humiliated man" who acted out of character by having two "straw donors" donate $10,000 each to his friend Wendy Long's unsuccessful 2012 U.S. Senate campaign in New York, and then reimbursing them.

The sentencing recommendation includes an unusual statement from D'Souza, 53, to U.S. District Judge Richard Berman in Manhattan, who will impose sentence at a Sept. 23 hearing.

D'Souza said the means he chose to help Long, a Republican he had known since both attended Dartmouth College, was "completely aberrant," and has led to his credibility as a public figure to be called into question. He added there was "zero chance" he would commit the crime again.

"I cannot believe how stupid I was, how careless, and how irresponsible," D'Souza wrote.

"I took a short-cut, knowing that there was a campaign limit and trying to get around the limit," he continued. "This should not have happened, and I am ashamed and contrite that it did."

The Mumbai-born D'Souza, who became a naturalized U.S. citizen in 1991, proposed community service that could involve teaching, instructing new immigrants in English, or working at the Boys and Girls Club of Greater San Diego.

D'Souza faces up to two years in prison. Federal prosecutors have until Sept. 8 to make their sentencing recommendation.

If I have $20,000 and I want to help a candidate out because I believe she is the best for the country, why is it a violation of the constitution to contribute that money to her campaign?

I agree. It appears he broke the law by trying to find a way to exercise his 1st Amendment right.

Symposium: The First Amendment’s protection of political speech extends to both donations and spending is a nice blog article about the 1st Amendment protecting contributions.

I blame SCOTUS more than any other entity for the gradual destruction and decay of our rights and country.

Of course not. Number one, these charges would never be brought against them.

“A wealthy politician can spend as much on his own race as he wants to without limits, yet he can not underwrite someone he feels would be a good public servant. He is limited to sometimes as little as $2,500. This leads to situations where that person will find 100 friends or employees to give the maximum, even if he has to promise in kind favors or even reimburse that person.”

Isn’t this part of that McCain/Feingold Act? Only certain entities are limited. I don’t think unions are limited. Indian tribes are not limited so that they can vote for McCain. I guess they just want millionaires to run. This law stinks and should be re-examined. Anything McCain pushes is going to be bad for conservatives in the long run.

This law stinks and should be re-examined.

It should be scrapped IMHO.

Pass a law that citizens and corporate entities are allowed unlimited contributions. Simply require all candidates to make public their donor lists.

It could be a two sentence law.

The sentencing recommendation includes an unusual statement from D’Souza....

***
Well, a statement in which the accused actually takes responsibility for his crime would strike a Reuters “reporter” as unusual; it’s usually leftists who engage in this sort of activity, and, in the rare instances in which they are prosecuted, there is always someone else blamed.

I like him, too. And, since he admitted his guilt, he is still on my list.

Of course, there are many, many Rats who will never be prosecuted for the same offense — or worse.

Wonder who is going after Harry Reid and his goofy looking granddaughter....

No dem/lib would ever be pursued for this same campaign violation, I guarantee it.

“I took a short-cut, knowing that there was a campaign limit and trying to get around the limit,” he continued. “This should not have happened, and I am ashamed and contrite that it did.”

“Did you really think we want those laws observed?" said Dr. Ferris. "We want them to be broken. You'd better get it straight that it's not a bunch of boy scouts you're up against... We're after power and we mean it... There's no way to rule innocent men. The only power any government has is the power to crack down on criminals. Well, when there aren't enough criminals one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws. Who wants a nation of law-abiding citizens? What's there in that for anyone? But just pass the kind of laws that can neither be observed nor enforced or objectively interpreted – and you create a nation of law-breakers – and then you cash in on guilt. Now that's the system, Mr. Reardon, that's the game, and once you understand it, you'll be much easier to deal with.”
