San Jose cops sued for stopping car carrying gunshot victim

A 16-year-old boy who was being driven to a hospital by friends after he was shot at a San Jose party died because police officers stopped the vehicle and then failed to provide medical help, the boy's father said in a federal civil rights lawsuit filed Thursday.

Gerardo Jorge Medina was struck in the stomach by a stray bullet fired at a party on the 10300 block of Murtha Road in eastern San Jose on June 13, 2013, according to the suit filed in U.S. District Court in San Francisco.

It was about San Jose not meeting county standards on 8 minute response time for 90% of calls. For over a year. Only city in the county that did that.

San Jose, at over 1 million people, contains more than half of the county's 1.7 million people. Most of the other cities in the county, like Morgan Hill, have 40,000 people and are under 13 sq mi in area. It's not exactly an apt comparison. It's the difference between a massive urban center and tiny suburban enclaves. The fact that they have different problems and issues and response times should not surprise anyone. You might as well compare NYC and Mayberry.

Don’t drive yourself!
Depends on your situation, local EMS. If they have a quick response time etc, most of them can now do an EKG in the ambulance and transmit to the ER. If we see an obvious MI we can start calling resources ( cath lab cardiology etc) BEFORE you get to the ER.

If not take an aspirin if your doctor has told you it’s okay for you, and have someone else drive you to the ER.

They didn't meet the county requirement.

I don't want whining, I don't want excuses, I want results.

The budget needs cut for not meeting requirements.

Hint... the private ambulance that used to serve this area responded faster and had less expensive services. And they were self-funding.

Why government is responding to emergencies besides invasion is a mystery.

They don't do it better, they don't do it faster, and they don't do it cheaper.

But they do have a monopoly.

Time to privatize some services, and nuke some government pensions.

*Kids* (teens) are taught to call 911 from the time they are very small. There is no reason for them to not have thought of it.

What I meant was that kids do stupid things that are perfectly inexplicable. I know I did. I know my own kids did. I'm happy we didn't have to die for it.

In San Jose and many other places in California, the ambulance may not be dispatched at all and its response time may be more than 25 minutes. They will also demand police escort and scene security before they will roll out in many places there.

It’s a bit twisted, but it’s truth in television when the ambulance won’t be there for 30 minutes.

See my post above - in addition there are or at least were parts of LA that the ambulance crews would simply refuse to go. The dispatch request would mysteriously get lost. Same thing in a lot of other cities; Chicago and New York housing project areas come immediately to mind.

Calling 911 is fine if you know they’re going to be there fast, if you live in an area where this is known behavior. It is not fine if you know the ambulance isn’t going to get there in time or worse isn’t going to show up at all.

The last thing they should have done was put him in a car. They could have actually contributed to his death in doing so. Their first move should have been to call 911. Someone on the other end of the phone could have given them instructions on what to do until medics arrived. Sounds like these kids watch too much TV. Throwing a seriously wounded person in the back seat of a car and driving them to a hospital tends to be a regular theme in many programs.

29 years ago this week my girlfriend collapsed at a local mall while we were waiting to go see a movie there. She was conscious but completely lost all limb function. We were at the Food Court when it happened. I ran out to the parking lot and got her car because I had a CJ-5 unsuitable for the task. I carried her from the Food Court to the vehicle. As I was loading her in the car a city cop pulled up. The officer said which hospital and I told him. He said follow me closely and we took off for the ER with him running lights and siren.

It was about a 10 mile trip and touch and go with her. We pulled in to the ER and they were there outside waiting. The cop got out and said Good Luck. We never got his name. I do believe had we been delayed any longer she may not have made it. Thankfully she did. When life is fading away seconds can determine the outcome.

Today we've been married will be 29 years in Nov. We live in a rural area. Every single time she has had an emergency I take her to the ER myself because I can have her there getting help before the paramedics have time to arrive. Usually VFD responders will beat the paramedics on scene in my area.

If the 911, radio/dispatch and in car camera recordings haven’t been ‘lost’ or ‘accidentally destroyed’ it will all have been recorded - from the time the cop called in their plate to the time he eventually called the medics. Want to bet there was a pretty long delay there?

Thanks for sharing your story, and I’m glad your girlfriend recovered and became your wife. I live alone. My kids live too far away from me to be of any help. The one and only time I had to go to the emergency room, I drove myself to the hospital which is just five minutes away. At this point in my life, I’m just hoping I’ll die in my sleep and not have to deal with calling 911 for anything.

To be honest no matter what happened elsewhere in this article the kids did the right thing by taking him in themselves or attempting to. I'll explain it. As soon as you call 911 and you say shooting that automatically 99.9% of the time will have the paramedics ordered to be staged a few blocks from the scene until cops arrive and clear the scene. Meaning simply they have protocol not to go in to such a call before given the OK by an officer on scene to do so.

Here is something else to consider about 911. It was a great idea when it was first developed. It was however developed before massive cellphone use as we know it today. One minor fender bender on a busy road or Interstate and you can have literally hundreds of persons calling in at the same time. I do not call 911 for such unless it's on a more isolated road and I am first on scene. Generally if you don't get a 911 operator within a few rings that is what has happened.

That's not a bad thing.

In Dec, 2009, I was on the side of a mountain, alone, at night during a blizzard after having fallen from an invisible cliff (it was to me), coated with ice.

I lost my left kidney, spleen, broke 2 verts and 3 ribs. One rib punctured my chest cavity, but not my lung.

It was 4 hours before the volunteers got me off the mountain. The state guys couldn't move because of the blizzard.

Dying, and I did that part right up until the bitter end, with ER docs saying NO. was the hard part.

Dying in bed would be a great thing in my book.

I already did the hard part once.

My concern is that I'll have to do the hard part again, instead of going to sleep and not waking up when the catz want fed.

I shot a thumbs up at a family of 4 today, Mom, Dad, and the 2 kidz. All were enjoying snowcones on a hot Texas day, and they were visible, and obviously a family...

And I'm a sucker for that kind of stuff.

I love to see intact families pulling together during hard times and enjoying to good times.
