Albion Gun Shop Records Taken, Gun Owner Arrested, as SAFE Act Enforcement Barrels Down

A NY SAFE Act investigation has begun at a business in a neighboring county. The Albion Gun Shop, located on Hamilton St. in the Town of Albion in Orleans County, has received a "request" from the New York State Police for records of all persons who have purchased a bullet button AR-15 from the store since the SAFE Act was passed and signed into law in January of 2013,

A bullet button AR-15 is a rifle that has been modified with a special feature that makes a semiautomatic rifle's magazine permanent, or not detachable without a special tool.

The NY SAFE Act makes detachable magazines on a semiautomatic rifle illegal for purchase after the SAFE Act passed, as well as required for registration as of April 2014 if purchased before the SAFE Act passed.

The state police can demand access to these records anytime, and no warrant is necessary.

According to Joseph F. Palumbo, the gun shop owner, he was given 24 hours to comply with the request he received last Thursday (Aug. 28) and on Friday he handed over approximately 170 customer records.

According to Palumbo, he said he had spoken with state police last year in regards to the legality of selling AR-15's with the bullet button attachment.

He said police advised him that it should be "ok" but wouldn't guarantee him an answer until someone goes to court for it.

According to Palumbo, he said he was told that there had been a plan to raid the gun shop with the SWAT Team, but the lead investigator felt it would be best to go in peacefully.

Is there a requirement that records be kept in English?

The records, which the moron reporter would know if he/she/it asked, are federal Forms 4473 and their NY State equivalents. Yes, they are in English. It doesn't matter, though, because these gun store owners are so awed by NY authority that they will fink on anyone.

Seriously, WHY would anyone who cares about their rights continue to live in these slave states, like NY, NJ, CA, DE, MD, RI, HI?

Call some friends to help defend the shop. I’m sure they would have SWAT out gunned and may even teach them a lesson.

The shop owners lack the guts to do so. They bow to tyranny. They get on all fours for tyranny.

He harmed no one with his rifle. So, while the state may try to ruin Morgan’s life, Morgan may play turnabout on the state. If it goes to trial, no jury in anti-SAFE Act- Orleans County will convict him and this could spell a death blow to the egregiously anti-2nd Amendment SAFE Act. Once jurors - as is their right- start using jury nullification to veto the SAFE Act prosecutions - as the unconstitutional monster that it is - it could spread like a brush fire of freedom making it impossible to enforce the SAFE Act anywhere in the state. Since it only takes one out of 12 jurors to hang a jury, there is probably no jury in the state that, if they are informed of their right to veto through jury nullification, that will not vote to hang or acquit on any SAFE Act prosecutions where there is no victim. This could spell the death of the SAFE Act.

It’s clear to the casual observer that the gov’t doesn’t want the citizens to have the means to defend themselves from the gov’t.

Why anyone can’t see this is a mystery.
It’s understandable why people aren’t getting up on their hind legs and shouting this - because of the fear of being marginalized as some sort of kook.

The left has done a good job of creating this societal atmosphere over the decades - any opposition to gov’t makes you a dangerous kook.

Buying a firearm has gotten so complicated. The last time I bought one I had to fill out the form, which changes every few years, then the clerk went over it, showed me where I needed to make changes, then all the changes had to have my initials and date by them, then he called HIS supervisor over who placed a template over the form to make sure all the proper spaces were filled out properly.

I long for the old pre-1968 days when all you had to do was hand the clerk your money and he handed you the gun. No questions asked.

I wonder if Indian Reservations can go into the gun selling business as they are under FEDERAL LAW and not State law.

I can see every little reservation having a casino and gun store in California and NY.

ATF went in and seized the computers of Ares Armor in San Diego this past spring. Luckily, nobody was arrested and Ares customers rallied and patronized the store quickly so no revenue was lost.

Ares is owned by veterans and they are great guys.

ATF went in after they were held off by an injunction. This is happening far too often in trying to keep us "commoners" from the means to protect ourselves!

Anyone who thinks they can have a background check performed then buy a firearm and for there to be no records held by the feds is driving a Obama vehicle.

I stopped by the GM Dealership yesterday, for a look at the new Silverado pickup. Just for fun, I took it out for a test drive. I wanted to sense that new “feel” before they become extinct.

The salesman (a man wearing a “Obama for change” lapel pin sat in the passenger seat describing the truck and all its “wonderful” options. The seats were of particular interest. He explained that the seats directed warm air to your butt in the winter and directed cool air to your butt in the summer heat.

Feeling like messing with him, I mentioned that this must be a Conservative truck.

Looking a bit miffed, he asked why I thought it was a Conservative truck.

I explained that if it were a Obama truck, the seats would just blow smoke up your ass year-round.

I had to walk back to the dealership. Damn guy had no sense of Humour.

I am sure these state police officers are just doing their jobs and they don’t write the laws they enforce. Ask them about the oath they swore and they will say “I was just doing my job...” Same line we heard at Nuremberg.

Pay a JBT enough and they will do anything and the Constitution and right and wrong be damned.
