Hardly, they were operating under the same rules as the US military at the time. Even if they were under fire there was no reason to be blasting anything that moved, just because they could. In any event they should be thanking their luck stars they are being tried in the US instead of Iraq.
No they weren't...that's why they were there in the first place, to do the real dirty work at Uncle Sam's behest.
