The guys's excuse, he was waiting for his children, sounds a little bogus, but can the police just tell someone to get moving because they look suspicious?

Except that he was sitting in front of his kid's preschool, they were there, his arrest and tazering was witnessed by a member of the preschool staff, and her statement to the police was also a reason for the charges to be dropped.

The only thing that was bogus in all of this were the original charges.

Yes, but the question remains: can the police legally order someone to move along if they’re loitering in front of a private business? If they can’t, then this guy can sue the bejeesus out of the St. Paul police dept.
