Jake Tapper: Getting a conviction against Darren Wilson could be an ‘uphill battle’

CNN host Jake Tapper had some discouraging news for those who would prefer to see not only Ferguson police officer Darren Wilson go to trial but be convicted for his role in the slaying of 18-year-old Michael Brown. Getting a conviction, let alone creating a case which would see the inside of a courtroom, will be difficult for prosecutors.

In an interview with Georgetown University Law Professor Paul Brown, Tapper asked what evidentiary thresholds prosecutors must clear in order to create a strong case against Wilson. Tapper observed that the grand jury hearing the details of the case is made up of three African-Americans and nine whites, suggesting that the demographic most incensed by the teen’s killing are underrepresented.

He added that Democratic Missouri State Sen. Maria Chappelle-Nadal has warned that, if the case does not go to trial and/or Wilson is found not guilty, Missouri should be prepared for all of Ferguson “to have looting.” Unfortunately for Missouri, murder trails do not hinge on the threats of local politicians.

“The hardest thing would be that the defendant is a police officer,” Brown said of the obstacles in the way of prosecutors. “Often jurors are extremely sympathetic to police officers.”

Moreover, the prosecutors have to prove that Wilson did not have a reasonable belief that his life was in danger, Brown said. Worse for those who are suspicious of Wilson, the testimony of those eyewitnesses who claim that the slain teen was surrendering when he was shot is not going to enjoy much credibility with the jury.

“Eyewitness testimony is notoriously unreliable,” Brown said.

Finally, while it is possible the grand jury will decide to indict, a conviction is going to be harder to secure. The racial makeup of the grand jury, Brown said, will come into play and the preponderance of whites on the jury, who have likely had better experiences with the police than their black counterparts, may mean that Wilson gets the benefit of the doubt.

Film of the “gentle giant” throwing around that liquor store clerk like a rag doll...a young woman who’s appeared on TV saying there was a physical confrontation between the cop and the punk...the photos of the cop’s facial injuries don’t bode well for a successful prosecution.


I am really concerned about a trial. The only reason Zimmerman was acquitted is that the RATS uncharacteristically dropped the ball. Ordinarily they would have arranged for a judge even more biased than Zimmerman’s who would exclude all this evidence. For some reason they also did not get to the jury. They let on some smart and tough women who were able to talk the wavering woman ‘of color’ into voting for acquittal. Later, after the RATS got to her, the woman ‘of color’ recanted her vote and said she was railroaded by the other jurors. Also Zimmerman got an outstanding set of lawyers.

We cannot count on this happening again. The Left will be gunning for the police officer and if there are any blacks at all in the jury the best we can hope for is a hung jury.

I agree. For the white jurors, their first priority should be to appease the black jurors. After all, as white people, their responsibility is to help build the negro's self esteem. And, if that means to wrongfully convict an innocent person, so be it. /sarc

The sad thing is that it will take a majority of whites to acquit him. If there was real justice, an all black jury would acquit.

Of course, Mr. Jake Tapper and CNN would never rush to judgment and convict an innocent man in the court of public opinion by lying, distorting, and unreporting of the facts and evidence, would they?

Yes, they would; we saw the MSM, race baiters, and prosecution try to defame and destroy George Zimmerman in the Trayvon Martin-George Zimmerman trial. Fortunately the jury saw through it and returned a verdict based on the evidence and not the lies of the prosecution and Martin's lawyer.

Jake Tapper is despicable. If police officer Darren Wilson is not indicted by a grand jury, will he then go on a rant about racist jury members? You bet he will because that's the racist plot line the MSM follow.

Quiet! If they aren’t on the jury duty roster, they are not likely registered to vote!
Actually though, in a perverse way, by not being registered and taking their turn as jurors, they are screwing their “men” who are coming before the bar of justice in large numbers. I vote, I serve on juries, and I have and will put you away if the evidence says you are guilty and it has nothing to do with the color of your skin!

Why is getting a conviction of the cop the goal? If that’s the case he’s convicted before even the grand jury convenes.

Shouldn’t the goal be to get to the truth?

OTH, Wilson's interests are underrepresented until they get a jury with all white cops on it - jury of your peers applies to the accused, not the deceased.

I don't believe any have been released.I've seen several reports indicating that he suffered noteworthy...and perhaps even serious...injuries to his face.These reports may,or may not,be accurate.But if they are true evidence of these injuries will eventually become public...perhaps not until the trials (there will surely be two...one state,one Federal).If they're not true that might hurt the cop's case.

I think there's little doubt that the photos of Zimmerman's bloody face/head are what saved him in his case.If similar photos of this cop exist he'll probably get off free.
