Congressman Randy Forbes joined House Judiciary Committee Chairman Goodlatte in sending a letter to Attorney General Eric Holder asking what the Department of Justice plans to do in light of a recent decision by the U.S. Court of Appeals for the 4th Circuit that could endanger our communities by allowing criminal gang members to receive asylum in the United States or withholding of removal by simply claiming that they have renounced their membership in the gang. Congressman Forbes also introduced legislation (included in H.R.2278) to ensure that anyone who is or has been a member of a gang may not receive asylum or withholding on any grounds.

<><> Advocated for a comprehensive approach to address gang violence during a House Judiciary Crime Subcommittee Oversight Hearing. Rep. Forbes pushed for an approach to combat gang violence that would emphasize tearing down gang networks, using faith-based organizations to work with former gang members, and targeting gang members who have come to this country illegally. Rep. Forbes said, “We need a combined approach that tears down the gang networks, that understands murder by a 17 year-old is not any less fatal than murder by an 18 year-old. And an approach that recognizes that when 80 percent of some of the most violent gangs in our country come here illegally, you will not stop this with prevention programs alone.”

<><> Cong Randy Forbes is Assigned to Subcommittees on House Judiciary Committee. Congressman Forbes will continue to serve on two subcommittees of the House Judiciary Committee. The Subcommittee on Crime, Terrorism, Homeland Security and Investigations has jurisdiction over the Federal Criminal Code, gang violence, drug enforcement, sentencing, internal and homeland security, cybersecurity and criminal law enforcement. The Subcommittee on the Constitution and Civil Justice has jurisdiction over constitutional amendments such as the Balanced Budget Amendment, constitutional rights, federal civil rights, state of religious freedom in America, medical malpractice, parental rights and tort liability.

Reports show HHS is transferring thousands of unaccompanied illegal minors, some of whom have already been identified as gang members by U.S. Border Patrol agents, to large U.S. cities that rank among the top strongholds of the American gang Mara Salvatrucha, or MS-13.

As CNSNews.com reports, a 2008 report indicates that MS-13 is one of two predominantly Latino gangs whose membership has spread from the Los Angeles area to other U.S. communities. MS-13 and the 18th Street gang (M-18), the report states, are becoming “transnational,” in that they are being established in Central America and Mexico. The report continues: “Evidence suggests that these gangs are engaged in criminal enterprises normally associated with better organized and more sophisticated crime syndicates,” and “gang members may be involved in smuggling operations and, by extension, could potentially use their skills and criminal networks to smuggle terrorists into the United States.”

Cities listed as strongholds of MS-13 include Washington, D.C. and the surrounding Northern Virginia area, Los Angeles, Houston, New York City, Baltimore, and Nashville. The more than 57,000 illegal unaccompanied minors who have flooded across the U.S. border from Mexico since October of last year have come from Mexico, Guatemala, Honduras, and El Salvador – all countries with strong ties to MS-13 and other Latin American gangs and crime operations. HHS has transferred many of these illegal minors, who are waiting for their cases to be heard by an immigration judge, to shelters primarily run by non-profit groups and religious organizations.

A map published by NumbersUSA.com identifies cities in which temporary shelters have been set up for the young illegal immigrants.
