And the Texas Constitution as far as defining militia, is unconstitutional because it makes it unlawful for the citizenry to organize under arms. Texans need to start there, IMO. Where do you get that? I did search over the text and the only mention of militia is the section I posted.
Furthermore, nothing in the TX BoR seems to support your claim:
Art, Sec. 23. RIGHT TO KEEP AND BEAR ARMS.
Every citizen shall have the right to keep and bear arms in the lawful defense of himself or the State; but the Legislature shall have power, by law, to regulate the wearing of arms, with a view to prevent crime.
