Police Overkill (Florida woman arrested after buying allergy medicine)

TALLAHASSEE (CN) - Florida sheriff's officers falsely arrested and imprisoned a woman with allergies for buying two boxes of Sudafed at a drug store, she claims in Federal Court.   

  Mickey Lynn Goodson claims she bought the two boxes of the over-the-counter drug because the pharmacist recommended it. She sued Gadsden County Sheriff Morris Young and the two officers who arrested her, Rodney Moore and William Buckhalt.     

Charges of possession of a controlled substance were eventually dropped, Goodson says in the July 18 complaint.     

In July 2010, Goodson says, she went to a Winn-Dixie store to get Sudafed "because she has allergy flare-ups." Sudafed contains pseudoephedrine, which can be used as a precursor chemical in some recipes for methamphetamines.     

"The pharmacist on duty suggested that plaintiff buy two boxes of Sudafed and she did," the complaint states.   

  "Almost immediately," defendant Officer Moore drove up in an unmarked police car, Goodson says. Moore blocked her and her husband's car, prevented them from leaving, and asked if she had just bought Sudafed... (snip) 

 Defendant Buckhalt arrived, with other deputies, and searched the Goodsons' car. They were taken to a sheriff's station, where Buckhalt asked if he could search their home. The Goodson said no, "unless there was a search warrant...

Plaintiff was arrested on her front porch after Buckhalt obtained a search warrant on false and misleading statements and evidence," the complaint states. "Later, when an Order Granting Motion to Suppress was entered suppressing all evidence received pursuant to the search warrant, the Judge stated that 'had the magistrate been aware of the omission [of critical evidence and facts in the documents signed by Buckhalt to obtain the search warrant] he would not have found sufficient probable cause for issuance of a warrant." Goodson seeks punitive damages for false arrest, false imprisonment, Fourth Amendment violations and negligence.
She is represented by Marie Mattox, of Tallahassee.

Good for her.

I don’t think that’s what it’s about, really.

Whenever there is a law out of the control-freak left that can affect the law abiding,

you can be guaranteed that that’s who it will be enforced ruthlessly on,

and true criminals will slide.

Think about the effects of “zero tolerance” rules in schools - who gets in trouble and who gets a pass?

All the authorities need to do is see if somebody is buying 20 packs of allergy meds a day and go from there. But harassing normal purchasers of allergy meds is clearly meant to impinge on the middle class and make them oppose the “war on drugs” because they blame it for making it impossible for them to buy some minor medication that would make their headache go away.

That makes zero sense. Put the blame where it it belongs, on nanny-statists and their vile War on Drugs.

I'll bet a 3am SWAT raid would change your mind about the WOD in a hurry.

Welcome to the former United States of America, Land of the Free. We are now a police state. Run by the federal government. Assisted by politicians. Assisted by butt kissing military officers who kiss Obama’s butt to make rank after having over 200+ officers kicked out. I just got yesterday an email from Military.com that says that over 25 captains were in Afghanistan and were being kicked out of the military just as soon as they get back to the States. Another Obama cutting of qualified combat officers. Just as Stalin did.

I’m perfectly happy with the war on drugs. I don’t need freaks brewing meth next to me - or even using it.

There are some things society simply doesn’t need, and these chemical perversions are one of them. Refined drugs of this type - heroin, etc. - started only in the late 19th century, when European techniques were able to extract the active elements, and they were fine and a blessing to mankind when used for pain relief. But nobody can say they have not been a curse since they took over our society, especially at its lowest levels.

When the requirements were first implemented I bought some Musinex D, which contains the pseuoephedrine and asked for two boxes.

I know the girl who was ringing it up and she had almost a paniced look on her face. I then said that one box would do and she looked very relieved.

You have to show your driver's license every time you buy and they have to enter your driver's license number before they can sell it to you.

It has been that way now for about 8 years, so new hires probably don't know of the trap.

The law only applies to medications pseudo ephedrine in them. Your medications have none.

I had to give my drivers license to the pharmacist when I bought over the counter Sudafed. I wanted to get two boxes and he said that I couldn’t do it, so I bought the one box that had the most pills in it, and then went back two weeks later and did it again. I did that for about two months until I felt that I could get through cedar season without dying.

Why is that not a criminal offense? If they lie to obtain a warrant they should be prosecuted.

I am not allergic to cedar pollen but to my surprise, after eating a piece of fish cooked on a cedar plank, I awoke the next morning with my tongue swollen. I could not close my mouth because of my tongue. I feel very fortunate that I did not suffocate in my sleep. Not going to make that mistake again. Two Benadryl took care of it and that was a good thing because we were miles from an ER out in the Montana hills.
