False. The Oath of Office for the North Carolina Attorney General requires the holder of the office to obey federal laws before state laws. When the 4th Circuit orders you to do something, you do it, unless you can get a stay from the US Supreme Court.

"I, _______________, do solemnly swear (or affirm) that I will support and maintain the Constitution and laws of the United States, and the Constitution and laws of North Carolina not inconsistent therewith, and that I will faithfully discharge the duties of my office as Attorney General, so help me God."

That’s a waste of time. Gay marriage is done as judicial and legal issue. The Supreme Court may not even need to rule again it looks like, although it might anyway just to make the point clear. Lawyers, elected or not, pretending otherwise just look stupid.

Constitutional change, which is to say political change, is the only way to reverse the legal outcome.
