Jonathan Gruber, along with Ezekiel Emanuel, is considered one of the architects of Obamacare. So when he is caught on video admitting the plaintiff's premise of Halbig vs Burwell which was this week ruled in favor of the plaintiffs it went viral on the Web. The court (and Gruber in 2012) agreed that Congress meant that the states would receive subsidies as an incentive to set up their own Obamacare exchanges. Although, Gruber vociferously denied this recently by claiming the problem was merely a "typo" in the legislation, he is completely contradicted by his earlier statement in January 2012 which you can see after the jump.
So how does the left and their media enablers explain this away? As of this writing the answer is they haven't...with the notable exception of General Electric Vox. And if the lame Vox excuses are any indication, they sure have their work cut out for them since Vox writer Adrianna McIntyre admits Gruber validates the case against Obamacare.

He’s a liberal. He doesn’t have to explain anything. The bottom line is he made a killing helping set up state exchanges. And that’s why he was trying to get states to set them up.

If congress made a mistaken then congress has to fix it, it’s not the courts job to fix congress’s mistake.

I'm sure there is a 3rd proof and I believe it is the fact that State and Federal Exchanges are in different sections in the Obamacare Text.
Of course, this Gruber is just another liar like Obama and the entire administration.
But isn’t what probably happened here that this was, as Gruber and the law said, it was intended that the subsidies would be an incentive for states to set up their own exchanges. And then, when SCOTUS ruled, they ruled that states had the option to opt out of the new Medicaid expansion contained in Obamacare.
So, opting out of the Medicaid expansion gave states an incentive to further minimize their involvement with Obamacare, and then 30+ states elected to opt out
The remedy to save Obamacare should be for Congress to provide a legislative correction to the written law. But that won’t happen now, so Obama and the Dims and their lackies in the courts will try to save Obamacare through the courts.
The only mistakes Rats made in drafting the bill were betting that the carrot held out to states who created their own exchanges would be big enough and that states that balked would be besieged by their citizenry. Fail on both accounts.
There was no mistake in the clearly written statute that federal subsidies were available only to residents of states who created their own exchanges. That’s unambiguous. “Stroke of the pen, law of the land.” Hope Obama and his Rat cronies enjoy the view from the top of their petards.
And that lame excuse will be good enough. When it should be reason to overturn the law. He admits CONGRESS MADE A MISTAKE. I wish someone would have “made a mistake” and included legalizing slavery in the bill. Since nobody read it would it be “simply a mistake and congress didn’t mean it”?
That’s always liberals’ excuse. “They didn’t mean it.” I pointed out Obama’s stupid statements to an Obama toe sucker and he said “He didn’t meant it.”
That is unbelievable.
