Republicans like Sen. Ted Cruz from Texas were quick to pounce on the decision as one that reveals the Obama administration’s ongoing attempts to implement the law in a way that exceeds the parameters set in the law that Democrats themselves devised and passed. Cruz called the ruling a “repudiation of Obamacare and all the lawlessness that has come with it.”
“The Obama administration, through the Internal Revenue Service, has attempted to dispense revenues to the states without proper congressional authorization, robbing Congress of its constitutionally-provided power of the purse,” Cruz said. “This decision restores power to Congress and to the people and if properly enforced, should shield citizens from Obamacare’s insidious penalties, mandates, and subsidies.”
House Speaker John Boehner (R-Ohio) said the ruling shows Obamacare is essentially unworkable, since it means premiums for millions of people will have to rise in lieu of subsidies.
“It cannot be fixed,” Boehner said of the law. “The American people recognize that Obamacare is hurting our economy and making it harder for small businesses to hire, and that’s why Republicans remain committed to repealing the law and replacing it with solutions that will lower health care costs and protect American jobs.”
Boehner also noted that the ruling marks the second time in the last few weeks that a court has ruled against Obamacare. In late June, the Supreme Court found in favor of Hobby Lobby in a ruling that supported the religious freedom not to cover certain contraceptives.

It will be appealed en banc, where the Dems have a 7-4 advantage thanks to Harry Reid and the nuclear option.
If Boehner is for repealing Obamacare, then why isn’t there a vote on it in the House - TODAY?
They’re are probably on summer break.

Because the House RINOs are gutless cowards. They're hoping that the courts will do their job for them, forgetting Roberts' act of judicial sodomy on the U.S. over Traitorobamacare.

This will be overturned. Bet the farm. What bothers me is I am not at all sure that SCOTUS will take the appeak and less sure they will overturn the ruling that overturns this one. Roberts sure won’t vote for us.

Obamacare gets repealed and then there are less than three months for Republicans to make it work before the Mediacrats blame republicans for the Obamacare fiasco.
The Republicans are FOOLING themselves if they think that court decisions like this are going to undo Obamacare. They need to start developing their talking points — and a war chest to communicate them — to turn the tables on him when he tries to blame them for the rising premiums.
Very possible in the DC circuit. However, there is a similar case in the 4th circuit and most observers think that will go the way this one did with the panel. That would result in conflicting rulings in the circuits and a certain trip to the Supreme Court.
Basically, the Supreme Court would have to conclude that the IRS has the power to supersede the clear language in the law which says that subsidies can be paid only to people who have signed up for state exchanges. IRS does not have that power.
Yikes, just saw an article saying the fourth circuit ruled the subsidies to be legal. So if the DC circuit overturns the panel there is no conflict among the circuits. :-(
Why wasn’t the second case mooted after the first ruling?
Passed, and dead at the Senate? (due to poor leadership in House and Senate, but mostly Senate)

Brought up as window dressing to improve reelection for those that need it, with no intention of playing hardball to get it signed into law.
The later I’m sure. The day the GOP takes over the Senate, all attempts to repeal Obamacare in the House will cease.
