University of Texas May Use Race As A Factor In Admissions, Court Rules Federal appeals court rules in affirmative action case that barring race as a factor would harm diversity on campus

A federal appeals court panel ruled Tuesday that the University of Texas can continue using race in its undergraduate admissions, a year after the US supreme court sent the case back to a lower court.

A 5th US circuit court of appeals panel ruled 2-1 that barring the university from using race would hurt diversity on campus. The ruling came in a lawsuit filed in 2008 by Abigail Fisher, who is white and was denied admission.

"We are persuaded that to deny UT Austin its limited use of race in its search for holistic diversity would hobble the richness of the educational experience," the panel found.

The only aspect of race that the states have amended the Constitution to expressly protect is voting rights as evidenced by the 15th Amendment.

According to the court, discrimination is now protected under the Constitution. I’ll have to remember that.

Such an enlightened age we are living in huh?

And they justify discrimination against whites by saying if we don’t it will “hobble the richness of the educational experience.”

What does this even mean? I’m trying to formulate words to express my thoughts but can’t seem to find them.

What’s being left out is the top 10% system is BS as well.

Let in the top 10% from Detroit and the top 10% from Grosse Pointe into Michigan’s system and Im sure they will all succeed.

Abigail was in the top 12% of a mostly white and Asian school district (Sugar Land TX). If she went to school in the ghetto she probably would have bene top 5%.

The Supreme court ruled against t.u.
That doesn’t stop them.
The have quotas and that is that.
White kids with high grades and lots of potential have to get behind ethnic or foreign applicants. That is the culture of the school. That is the choice they have made.
I have family and friends who graduated from there, but they will not send their kids there because of the radical change in the culture of that school. They send their kids to Tech or A&M instead.

If the SC ruled against UT then what is this last court ruling about? Is UT just a smaller version of Obama and they do what they want regardless?

Mine went to TT.
