Boehner: House will sue Obama

Speaker John Boehner (R-Ohio) on Wednesday said he plans to sue President Obama on behalf of the House over his frequent use of executive actions that Republicans believe are beyond his authority.

During his weekly Capitol press conference, the Speaker accused the president of violating his oath of office by not “faithfully executing the laws of our country.” But Boehner said the lawsuit would not lead to an attempt to remove Obama from office.

“This is not about impeachment,” Boehner said. “This is about his faithfully executing the laws of our country.”

The Speaker would not say what specific executive actions the House would challenge, though Republicans have long complained that Obama has exceeded his authority in the various delays the administration has announced in implementing the Affordable Care Act, as well as the president’s enforcement of immigration laws.

A lawsuit could take years to wind through the courts and outlast the Obama presidency. Minority Leader Nancy Pelosi (D-Calif.) on Tuesday called the move “subterfuge,” but Boehner denied it was designed to gin up the Republican base ahead of the November midterm elections.

“This is about defending the institution in which we serve,” he said. “You know, if you look back over the last 235 years of our history, there’s been a movement between the inherent powers of the executive branch and the inherent powers of the legislative branch.

“And what we’ve seen clearly over the last five years is an effort to erode the power of the legislative branch,” the Speaker continued. “I believe the president is not faithfully executing the laws of our country, and on behalf of the institution and the Constitution, standing up and fighting for this is in the best long-term interest of the Congress.”

A Boehner aide said more details on the lawsuit could be made available Wednesday afternoon.

I think you are thinking of President Andrew Jackson.

Chief Justice John Marshall had initially opposed Jackson's election to the presidency, and in the Cherokee Indians case, Worcester v. Georgia (1832), Marshall infuriated Jackson by insisting that Georgia laws that purported to seize Cherokee lands on which gold had been found violated federal treaties. Jackson is famous for having responded: "John Marshall has made his decision, now let him enforce it." Although the comment is probably apocryphal, both Georgia and Jackson simply ignored the decision.

I'm absolutely sputtering with anger right now. The freakin' nerve of this dolt -- worrying about "defending the institution"????? I'm supposed to believe that crap??? Whining that an "effort" is underway to take away legislative power???? Boehner, you pathetic sorryass coward. You have THROWN IT AWAY WITH BOTH HANDS!!! One of think the people of OH would be ashamed of this man, but not on your life. They want him pushed on the nation as a whole. I would disagree about effect. Once this starts....if any executive order comes up...a federal judge on this episode could freeze the effect of the executive order. The President could say that no judge can make that decision and continue on...thus quickly getting this within days to the Supreme Court. The Supremes might get a 5-4 say that the executive order goes against law passed by Congress, and freeze the executive order.

My humble opinion is that the President would immediately stand up and continue on. At that point, defying the court....he’d be up for impeachment. I think the four members of the left on the Supreme Court now realize this implication and sitting quietly trying to seek a better and more logical outcome to this.

Absolutely NO one wants Biden as President. Somehow, a rational understanding by the President has to be achieved, or this last two years of time will be like a ten thousand-ton anchor on the Democratic Party and dropping to the depths where return is not possible.
