Redskins defy trademark ruling, say they'll defend name

In a defiant statement issued Wednesday, the Washington Redskins said the team would appeal the U.S. Patent and Trademark Office's decision to revoke the trademark to the team's name and logo on the grounds that they are offensive to Native Americans.
The professional football team added that in the meantime, the ruling would have "no effect at all" on its trademark rights while the case is on appeal. The press release even put that in boldface and underlined it.
"We are confident we will prevail once again, and that the Trademark Trial and Appeal Boards divided ruling will be overturned on appeal. This case is no different than an earlier case, where the Board cancelled the Redskins trademark registrations, and where a federal district court disagreed and reversed the Board," said Redskins lawyer Bob Raskopf.

From Foxsports "Assuming a stay of the ruling is granted -- that is, the ruling is not immediately enforced pending appeal -- the Redskins will have the right to appeal this decision and seek to overturn the ruling. If overturning this decision sounds unlikely, think again, the same ruling occurred in 1999, but was overturned due to a technicality on appeal. The appeal process will likely take years. During that time, nothing will change. That's why the Redskins official statement says as follows: "We are confident we will prevail once again, and that the Trademark Trial and Appeal Board's divided ruling will be overturned on appeal. This case is no different than an earlier case, where the Board cancelled the Redskins' trademark registrations, and where a federal district court disagreed and reversed the Board."

I think its an idiot decision but Legally I can’t see that they have much to stand on. Nobody has a Constitutional right to a Trademark.

The government is past being out of control It's arrogant.
Could this backfire? I'd think the Redskins can still use the logo, it just isn't there's exclusively. What has the nation come to when wearing a Washington Redskins logo is an act of defiance?

The latest ruling came after months of increasing political pressure by Reid, who in late May organized a letter signed by 50 Senate Democrats urging the team to change its name because it is supposedly offensive to Native Americans. To give an idea of the depth of Reids sincerity, the letter was not circulated among Senate Republicans, according to the New York Times, meaning the whole exercise is a transparent game of politics.

The other day I was thinking about what federal institutions and agencies might be worth salvaging in a revived America. I figured that the US Patent & Trademark Office and Library of Congress might be worth keeping intact. Guess I’ll have to modify that opinion.
