The U.S. Food and Drug Administration is "pushing very hard" to release a proposed rule that would establish its authority over e-cigarettes, the head of the agency said on Thursday amid concerns the products pose a risk to children.
FDA Commissioner Margaret Hamburg told senators at a Congressional budget hearing that it has taken too long to move the rule forward and that she expects the proposal to be ready for release "very soon."

What a monumentally stupid statement!
Oxygen is taken into the body, so...
...Congress must have also authorized the FDA to regulate that!
I’ve used e-cigs for over 4 years now and I’ll tell you what impending government regulation means to me:
- higher prices
- fewer choices
- less availability
It might help a few people but will shorten the lives of many people who would have otherwise switched from tobacco to e-cigs.
Government is not our friend.
It never considers that there are “enough” regulations.
They are in the business of control, and concern about our welfare is just an excuse for their actions.
I just love smug references without a source for verification.

I feel competent to understand most studies. Certainly to the extent of identifying what their findings apply to and to what they don't.
Blanket statements are usually a sign of misunderstanding or misapplication.
Sometimes.
And sometimes it's a way for the government to save money on Medicare, Medicaid, and disability SS payments.
It is also a way to keep costs down for those of us who pay for medical care for the indigent by having a portion of that care allocated to our hospital bills, else we'd be screaming our heads off even more about the high cost of medical insurance--and to slow the rise in premium costs for obamacare.
Now if the government didn't force hospitals to treat the indigent and if the government didn't pay for healthcare for the indigent and elderly, then doing what we want with our bodies--as we should be allowed--as far as the government is concerned.
So it's really your fault for wanting your tax money to be spent on medical care for the indigent, etc.
The FDA to release “Damnit, we don’t know how to tax these things” ruling to be released soon.
So is a cup of coffee.
As a society we agree to regulate these things.

But maybe not. Some places operate outside the law.
So sue them. There are legal precedents dating back to 1911 supporting the 1906 food and drug act as constitutional under the Commerce clause (Hipolite Egg Company v. U.S).
But you're smarter than they are so sue them. Boogieman vs the Supreme court. I'm sure they will quickly see the wisdom of your constitutional scholarship.
Just so you know. If you win, I'd support a Federal Amendment to the Constitution giving them specific authority to regulate food and drugs.

Through Medicaid, Medicare, Food Stamps, SS Disability, and various other programs. Medicaid is pretty much for people who can't afford to pay. And I pay for that in taxes. Medicare costs the government $1000 more a month than the premiums they get. And I pay for that through taxes. I pay for Food Stamps through taxes. I pay for SS Disability which goes to people that get disabled before retirement age, often through illnesses like COPD, through taxes. In addition, my health insurance, and healthcare still costs a lot more than it should because of people who can't afford to pay that the government doesn't reimburse providers for.
Why would an e-cig smoker be sick and broke?
For the same reason a smoker ends up sick and broke. You're putting chemicals into your lung that weren't supposed to be there. It's probably not nearly as bad as a cigarette. But you're still breathing in a variety of chemicals. You're one big self-guinea-pig. And I and the other taxpayers stand ready to bail you out and pick up your expenses if and when you can't.
Because it's obviously a drug delivery device.

Well, if you read the law, Congress declared this type of stuff to be clearly withing the FDA jurisdiction. The FDA has just been pretty slow about their responsibilities. So yes, people should take the Congress and the laws they passed seriously.
But it's the exact opposite of telling you, your neighbor's bank account belongs to you and he has to sit there and take it. What the government has been doing for as long as I remember, is telling me that my bank account belongs to the smokers. That I have to bail them out for their stupidity. And that I have to sit there and take it.
Now I encourage anyone who smokes to switch to e-cigs if they can't quit altogether. I do think it's safer that regular cigarettes. but that's unproven. There's a possibility people will vape more than they smoked. And it already appears that non-smokers are taking up e-vaping because they perceive it's safer.
And my bank account is there at the government disposal to pay for their care and upkeep when and if their decision to smoke or vape comes back to haunt them.
