House contempt vote for IRS’ Lois Lerner set for next week

The House Oversight Committee will vote to hold former IRS official Lois Lerner in contempt of Congress next Thursday.

Lerner, a key figure in the tea party targeting controversy that scarred the agency last year, has been under the threat of contempt for more than a month after she again invoked her Fifth Amendment right not to testify at a hearing.

Americans expect accountability and want Congress to do all it can to gather relevant evidence about what occurred and who was responsible so that this never happens again,” said Oversight Chairman Darrell Issa (R-Calif.). “Ms. Lerner’s involvement in wrongdoing and refusal to meet her legal obligations has left the Committee with no alternative but to consider a contempt finding.”

Lerner could theoretically be jailed if found in contempt, though that power has been used rarely.................Well let's change that

if the congress critters have to balls to hold her in contempt (LOL) I predict obozo will immediately issue a pardon and reward her and then reassign her with a pay raise. How about congress just indict her dog instead.

Holder is not involved in this. Congress really does have the power to throw her in jail, but this is rarely, rarely done.

If Congress actually did this, that pardon would be worth less than the person who signed it. It involves the separation of powers.

Even if they wanted to, I’m not certain that they can do this, due to the separation of powers.

For the same reason, no police can touch a congressperson who breaks the law while on official congressional business (possibly unless they are impeached and convicted by Congress itself). What happens AFTER that, another story, and it might get tricky.

IANAL (I am not a lawyer), but I THINK that they can do this even with the separation of powers (IRS being part of the Executive Branch), because she is not a political appointee hired directly by the present Administration).
