Lawsuit: Man Arrested, Searched For Marijuana Solely For Having Colorado License Plate

Boise, Idaho (CBS SEATTLE) – An Idaho state trooper arrested and fully searched a 70-year-old Washington man’s vehicle solely because he had a Colorado license plate – a state where marijuana is legal – a federal “license plate profiling” lawsuit alleges.

Darien Roseen was driving along I-84 between his second home in Colorado and Washington state on Jan. 25 when Idaho State Trooper Justin Klitch “immediately” pulled out from the Interstate median and began “rapidly accelerating” to catch up to Roseen, according to the complaint in a Courthouse News Service report. Exiting at a designated rest area, Roseen says he became “uncomfortable” that Klitch had followed him though he had not “done anything wrong.”

“At no point did Trooper Klitch’s line of questioning relate to Mr. Roseen’s alleged improper driving pattern,” the complaint states. “Instead, Trooper Klitch immediately accused Mr. Roseen of transporting something illegal.”

Roseen’s attorney, Mark Coonts, told Courthouse News that his client’s constitutional rights were given no regard.

“We believe that Americans should be able to travel interstate highways without being harassed and unlawfully detained because of license-plate profiling,” said Coonts. “Our client, Mr. Roseen, is a 70-year-old retiree who was returning from his daughter’s baby shower. He was stopped in Idaho and deprived of his constitutional rights because he was driving a car with a license plate from a state that ISP associated with marijuana.”

Might be more than just the CO plates involved. If there was a potential asset forfeiture involved, it might have been a combination of CO plates and a really nice car.

The ensuing search of the vehicle by multiple unidentified officers found nothing and Roseen was issued a citation for “inattentive/careless” driving.

Bad Cop all around

The problem with your position on this so called LEO never informed the citizen as to why he had been pulled over and in fact his line of questioning was all about “What’s in your car?”

After Mirandizing the citizen, he took the vehicle(Big no, no) to HQ and had his buddies rifle the car looking for anything they could find.

Upon finding nothing, he issued a ticket, for whatever charge he manufacture to make his stop legit.

Truth is: He wanted in the man’s vehicle so could proceed to charge him with a crime he didn’t even have “Reasonable Cause”(Forget Constitutional “PROBABLE CAUSE”)

Cop is a thug and needs to be fired.

You remind me of my Jr. High English teacher, but I’ll remember what you say. His thing was (I wish I could think of his name, but I can’t) you speak however you wish, it is not improper to SAY “ain’t” or “yous guys” or anything like that, but you shouldn’t write that way, except for dialogue I suppose.

Point well made. I missed that they impounded the car. After someone corrected me that there was no Marijuana in the car, I thought he was no longer detained. Impounding the car after finding nothing in it was clearly illegal.

OK, I agree.

An elderly man like that could have had a heart attack due to the aggressive behavior of the cop. I’d add in that legal suit something about his physical condition and the trauma he went through. Sue their butts off. This one really makes me mad.

Bad cop. Abused authority. Lied.

In our democratic-republic, the authority of any and all government agents to act for the purpose of enforcing our laws, comes from statutes made by our duly-elected legislatures.

Therefore, your actions as a law enforcement officer, are enumerated.

The mysticisms of many judges-in-robes, neither ends nor modifies that principle.

The bad and disgraceful artiface of too many cops, whereby they nudge a person into taking some action, such that the cop(s) *then* discover some reason for further baiting and goading ... is a course to police state tyranny.

The state trooper in this case, should be fired immediately with no chance for appeal. He can find something else to do, *lawfully.*

There is no room at all, for a failure of any state agent, to disrespect the principle that the public peace and trust rely upon government agents to do *only* that which our duly elected representatives enumerate.

I have been stopped one time by a cop, about 1991, and I was going 10 miles over the speed limit in my new black Jag. The state speed limit at that time was 55 and the Jag changed gears at 54 and that was really difficult to not go over the 55 speed limit with the gear changing like that. The car was in its groove at 65. Anyway, I got stopped on a divided highway in the country going 65 with no cars going either way except mine and I told the cop I WAS going over the speed limit. He said I was being nice and he really liked my car and I must have a nice husband who bought it for me.

I told him I lived my myself and bought the car myself. He said, “Can I come live with you?” We both laughed and he gave me the ticket and told me how to send the money in.

Finally, the state speed limit went back to 65 and my car was happy. I was always aware police would watch a Jag to see if they could ticket it for speeding. I didn’t get another ticket (but that doesn’t mean....).

In your zeal to protect so called good police work, you failed to comprehend the basics of the article. You didn’t take the time to do your own good police work.

You lost all credibility at that point. So I skipped reading the remainder of your posts because I know they would be unreliable and not trustworthy.

I’ve been “stalked” when exiting a bar/restaurant parking lot after a meal and a pint, and given the “follow the pen with your eyes” test when I turned down a side street to see if I was being followed or was just paranoid (”evading, he said). Passed the test, but a PITA. Not much different I guess.

Has happened to me too, though in a different way. After a day away from home that included some shopping in a large west Texas city followed by a nice meal with a beer, I hit the road to drive the 100 miles home. I realized I was getting very sleepy when I passed through a small Texas town. The local Wal-Mart parking lot where I wanted to doze was full of trucks loading and unloading so I drove across the street to a well lighted church parking lot.

I must have been really tired and been asleep for over an hour and was awakened by an officer tapping on my window. After giving him my license and registration, he told me to step out. Then I noticed that there were at least two other cop cars parked in back of me - the entire shift police force was there! He skipped the finger pointing but gave me a breath test - 0.00 is what I blew. The officer then apologized and said this was not the place to park but in back of the all-night convenience store down the road was o.k. At the time I had a modified McCain-Palin sticker on my bumper that said “I’m voting for Sarah” and he said he liked it. No ticket or warning, just a friendly “good night and drive carefully.”
